Sec. 4-66. Hig~aer standard to prevail in case of conflict with other ordinances or laws. In any case where the provisions of tluis article impose a higher standard than that set forth in any other ordinsnce or law, then the standards as set forth herein shall prevail, but if the provisions of this article impose a lower star~d~rd thau any other ordinsnce or law, than the higher standard con- tained in such other ordinance or law shall prevail. Sec. 4-67. Enforcement of and compliance with other ordinances. No license or permit or other certification of compliance with this article shall constitute a defense zo s-ny violation of any other ordinance of the city applicable to any s~ruc~ure or premises, nor shall a~ provision herein relieve ar~f owner, operator or occupant from complying with any such other prevision, nor ar~ official of the city fr6m enforcing any such other provision. Sec. 4-68. Responsibilities of owner, opera, or and occupant independent of eacln other. (a) Owners and operators shall have all the duties sand responsibilities-as prescribed in ~ection 4-69 and the regulations promulgated pursuanz thereto, and no owner or operator shall be relieved frmm any such duty and responsibility nor be entitled vo defend against any charge of violation thereof by reason of the fact that the occups~uv is also responsible therefor s-nd in violation thereof. (b) Occupants shall have all the duties and responsibilities as prescribed in section 4-70 and all the regulations promulgated pursus-n~ thereto, and the occupan~ shall not. be relieved from ar~ such duty ~ud responsibility nor be entitled to defend agains~ shy charge of violation thereof by reason of the fact that the owner or opera, or is also responsible therefor and in violation thereof. (c) Unless expressly provided to the con, ratty in this article, the respective obligations and respor~sibilities of the owuaer and operasor on one h~d~ ~nd the occupant on the other, shall noz be altered or affected by s-ny agreemen~ or contract by and between any of the aforesaid or between them and other parties. Sec. 4-69. Duties and responsibilities of owner s_nd operator. The following duties and responsibilities are hereby imposed upon every owner s~nd operasor of any buildirg covered by the provisions of this article: (a) The exterior of the premises snd all structures thereon shall be kept free of all nuisances~ and s-ny hazards ~o ~he safety of occupants, pedestrians s-nd other perso~m utilizing the premises~ and free of unsanitary conditions, and s-ny of the foregoirg s~l be promptly removed and abated by the owner or operaoor. The items prohibited hereby shall include, but not be limited ~o: brush, weeds, broken glass, svmmp roo~s, obnoxious growths, filth, garOage, trash, refuse, debris, dead and dying trees ann li~s or other natural grow~h~ loose and overhar~irg objects, and ground surface hazards. - 4 -
