AN ORDINANCE TO PROVIDE F©R THE ACQUISITION OF CERTAIN PROPERTY BY <br />THE CiTY OF PORTSMOUTH UNDER EMINENT DOF~iN PROCEEDINGS PURSUAA~ TO <br />CtLAPTER 126 OF TEE ACTS OF ASSEMBLY OF 1964, SAID PROPERTY BEING <br />NECESSARY POR THE CONSTRUCTION OF A CITY GARAGE AND PUBLIC WORKS DE- <br />PARTMENT EQUiP~LENT BUILDINGS° <br /> <br /> ~HEREAS, the present City Garage and Public Works Department <br />equipment building (affectionately known as the White House) are <br />situate within the limits of the Weaver Redevelopment Project, VA <br />R-40, and must be demolished immediately; and <br /> <br /> W~EREAS, the City of Portsmouth requires a site (through the <br />expanszon of the existing incinerator site) within which to erect a <br />new City Garage and Public Works Deparsmen~ equipment buildings; and <br /> <br /> WI~EREAS, the City of Portsmouth has found it to be necessary go <br />acquire the interesss hereinafter specified, in and to the hereinafter <br />described parcels of land-situate in the City of Portsmouth, Virgznia, <br />for the purpose of constructing the aforesaid buildings and providing <br />the yard spaces for use therewith; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase <br />certain property necessary ko this pro~ect because the owners thereof <br />and the City have noE been able to agree upon the price 5o be paid <br />therefor, or the City has no~ been able to loca~e certain of the owners, <br />or because of the ssatus of the title of certain parcels of the prop- <br />ersy; and <br /> <br /> ~EREAS, advancement of the work and occupancy of said buildings <br />will be delayed unreasonably if the said proper~y is not made available <br />as soon as possible. <br /> <br /> NOWz THEREFORE~ be it ordained by the Council of the City of <br />Portsmouth, Virgznzao <br /> <br />Section 1. The City Attorney is directed to institute eminent <br />domain proceedings, employing counsel for that purpose, against <br />the propersy hereinafter described located adjacent ~o the <br />presen~ incinerator szte, for the purpose of acquiring fee simple <br />title therein, ~n accordance with and pursuan~ to Section 23-f <br />of the Charter of the City of Portsmouth (Chapter 126 of the <br />Acts of Assembly of 1964), and to deposit to the credit of the <br />cour~ as provided by law the sums specified to compensate the <br />respective owners of the various parcels Of land, as follows: <br /> <br /> <br />
