AN ORDINANCE TO AMEND ~h~ CODE OF THE CITY OF PORT~40UTH, VIRGINIA, <br /> 1961, BY ADDING TW~Y~TO TWO NEW SECTIONS NUMBERED 19-82 AND 19-83, <br />--PROHIBITING PERSONS ~R ~ AGE OF TWELVE YEARS FROM ENGAGING IN <br /> '~ ACT~VI~f KN0~ AS "TRICK OR TREAT" AND PROHIBITiNG SUCH A~IIVi~I'~ <br />~af~ 8:00 P. M,, RESPEctiVELy. <br /> <br /> Be'it ore,fred by the Council of the City of Portsmouth, <br /> Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, 1961, <br />be amended by adding thereto two new sections numbered 19-B2 and 19-83, <br />such new sections to read as follows: <br /> <br />Sec. 19-82. Persons over twelve not to play "trick or treat". <br /> <br /> 3~' ~ person over the age of twelve years shall engage.i~. <br />the activity comuonly known as "trick or treat" or any other activity <br />of si~l~r cbs~acter or nature under arb~ name whatsoever, he shall be <br />guility of a misden~anor and sh~]t be punished by a fine of not less <br />than twenty-five dollarsror more than one hundred dollars or by con- <br />fiuement in J~] for not more than six months, or both; provided, <br />however, that nothing herein sb~]] be construed as prohibiting any <br />parent, guardiau or-other responsible person, having lawfully in his <br />castedy a child twelve years old or yotmger, from accompanying such <br />child who is playi~ "trick or treat" for the purpose of careing for, <br />looking after or protecting such child. <br /> <br />Sec. 19-83. Playing "trick or treat" after 8:00 P. M. prohibited. <br /> <br /> If any parson sh~l] engage in the activity conraonly known as <br />"trick or treat~' or any other adtivity of similar character or nature <br />under any name whatsoever after 8:00 P. M., he shall be guilty of a <br />misdemeanor and shall be punishe~ by a fine of not less than ten <br />dollars nor more than one hundred dollars or by confinement in jail <br />for net more thau thirty days, or both. <br /> <br /> 2.
