~ ORDINANCE TO ~MF~k.~ SECTION 3-9 OF TP~ CODE OF THE CITY OF PORTSMOb~H~ <br />VIRC-IN~ 1961~ PERTAINING TO CR~Y¥ TO ~I~LS SO AS TO CO~FOP~M TO <br />CHANGES IN THE G ,~TL%tL LAW F~NAC~ BY ~E G~qEPJ~L ASS~,~LY OF \~IRGI~TA <br />AT ITS 1968 SESSION. <br /> <br /> MHERK~S, the City of Portsmouth is authorized to erect ordinsnces <br />of the Code of Virginia~ provided such ordip~ces are substantially con- <br />sistent ~th the state law; <br /> <br /> ¥~E~, the General Assembly of Virginia ay its 1968 session ~mended <br />certaf~ provisio~s of the Code of Virginia, t950; and <br /> <br /> ~&S~ it is therefore necessary to amend section 3-9 of the <br />Code of the City of Portsmouth~ Virginia, 1961, so as to make said section <br />core, cfm to the chs.nges in the Code of Virginia, 1950, enacted by the General <br />Assembly of Virginia at its 1968 session. <br /> <br /> NOW, ~0RE, BE IT 0RDAI~7~ by the Council of the City of Ports- <br />mouth, Virginia; <br /> <br /> t. Tb~t Section 3-9 of the Code of the City of Portsmouth, Virgir~a, <br />1961, be ~ended and reordained to read as follows: <br /> <br />Section 3-9. C~elty to Dnai~als. <br /> <br /> Any person who (1) overrides, overdrives~ overloads, tortures~ <br />ill-treats~ abandons~ willfully inflicts ir2aumane imjury or pekin not <br />cormected with bonafide scientific or medical experimentation to, or <br />cruelly or unnecessarily beats, ~a~ns~ mutilates~ or kills ~ny smLmal~ <br />whether belongi~ to ~himself or another, or d~orives ~v s~uLr~l of <br />necessary sustems~nce, food, or ~rimk~ or causes smy of the above th~gs, <br />or being the o~.mer of such arbitral pe~ts such acts to be done by another, <br />or (2) v~dlfully sets on foot, instigates~ engages im~ or in any way <br />~urthers any act of cruelty to any aniw.~l; or (3) shall cs~u~j or cause <br />to be ca~ried in or npom any vehicle or vessel or otherwise any anL~a.1 <br />in a cruel, brutal~ or inhuman m~r~er, so as to produce torture or mn- <br />necessary sufferi~g~ shall be guility of a misdemeanor; but notching in <br />t~is section shall be construed to prohfoit the dehor~oirg of cattle. <br /> <br /> 2.
