AN ORDINANCE TO REORDAIN SECTIONS 19-54~ 19-55 AND 19-56 <br />OF T~E CODE OF ~E CITY OF PO?;I~MO~ZYH, V-~_RGINL~ 1961, <br />PERTAINING TO DISORDERLY CONDUCT. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1, That Sections 19-54, 19-55 and 19-56 of the Code of <br />the City of Portsmouth, Virginia, 1961~. be reordained as follows: <br /> <br />S&ction 19-54. Riotous and disorderly conduct - Disorderly con- <br /> duct generally. <br /> <br /> Any person vfno shall use any insulting, offensive~ obscene, <br />profane, or t~eater~ir~ language, ~nder circu~nstances tendir4~ to <br />end~_nger the public peace or- morals~ or in or near a dwellim~ house, <br />or in the presence of a female, or who s/~_ll fight, quarrel, make <br />any mnnecessar~f noise calculated to disturb the peace and good or- <br />der of the city, or other~rise act in a disorderly maomer~ shall be <br />punished as provided in section 7-1. If uny such langu~_ge be used <br />to~ard or in the presence of mny favale passenger by the driver or <br />operator of an automobile or other vehicle transporting passeHgers <br />for pay, the cour. t or Jury tryirg the offense may, in addition to <br />imposing pur~ishment as hereid provided for, declsa-e the license or <br />permit of such person revoked. <br /> <br />Section 19-55. S~me - In public conveyance ger~rally. <br /> <br /> If any person within the city, whether a passenger or <br />not, st~ll while in any public conveys~ce behave in a riotous or <br />disorderly ~ner, he shall be guilty~ of a n~sdemes_nor and, u%0on <br />conviction, shall be ~unished by a fine not exceedL~g five h~un- <br />dred doltars, or confinement in jail not exceeding twelve months, <br />or both. The agent or employees in ct~trge of such-public convey- <br />ance may require such person to discontinue his riotous or disor- <br />derly con@uct, and if he refuses to do so nmy eject him: with the <br />aid, if necessary~ of any other persons who may be called uoon <br />for the pu_~pose. <br /> <br />Section 19-56. Senne - In oublic places other th~_npublic convey- <br /> antes; disturbances on public conveyances. <br /> <br /> If ~ny person, w~thin the city, beb~ves ina riotous or <br />disord~riy m~nner Ln ~ny stree5, p~o!ic building or ~ny other pub- <br />lic place other tb2~n those mentioned in section 19-55~ or cause <br /> <br /> <br />
