Be it ordained by the Council of the City of Po~6smouth, Virginia: 1. That sections 13-29 and 13-31 of the Code of .the City of Ports- mouth, Virgir~a, 1961, be a~nded and reordained to read as follows: Sec. 13-29. License requi_~ed for landfill operation. It shall be malawful for any person to mintain or operate a ls~nd- fill or any place for tlne disposal of refuse, an~,~here in the city %~ithout first obtaining a license therefor; and it shall be unlawful to nmintain, operate, or permit the m~intenance or operation of any such place in violation of any provision of this article. Sec. 13-31 Application of License. (a) Applications for such licenses shall be filed ~th the Building Official and shall contain a description and plat of the land on which the landfill operation is proposed; a description of the sequence and plan of operation; availability of tine equipment for water supply; type and capacity of equipment to be used for operations; plans for fire, nuisance ~nd ve~in control; existing end proposed roadways ~nd easements; existing topography and ;ater courses: together~th a diagr&mand written statement exzplaini~ng proposed location and extent of earthwo~ and fill operations, proposed equip- ment and estimated daily or weekly volume of refuse, and such other pertinent information as may be required by the Building Official. (b) ~ne Building Official shall exsmine the premises smd shall also coordinate his investigation with the Department of Public Health and the De- part~, nt of Public Works zo dete~.~ne ~,fnether the grantir~ of the license to the applics~nt would or would nov violate the health regalations of the city or would in any way create a hazard or menace to the public health or would in any wa~ create a nuisance to the people of the city. (c) if the Buildir~ Official is satisfied that all the requirements of law have been met, then he shall issue a landfill operation license upon the payme~ of the proper fee in accordance with the following schedule:
