AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, BY REPEALING SECTION 13-4 THEREOF, PER- <br />TAINING TO THE SEPARATION OF GARBAGE AND TRASH; BY AMEND- <br />ING SECTIONS 13-2, 13-5, 13-14.1, AND 13-24, PERTAINING <br />TO THE RECEPTACLES FOR GARBAGE AND TRASH, THE DISPOSAL <br />OF SAME AND THE CHARGES FOR HANDLING REFUSE; AND BY ADDING <br />THERETO A NEW SECTION NUHBERED 13-23.1, PROHIBITING <br />tNCINERABLE REFUSE FROM THE LANDFILL, AND A NEW SECTION <br />NUMBERED 13-23.2, PROHIBITING THE DEPOSITING OF CERTAIN <br />REFUSE WITHIN THE CITY. <br /> <br /> Be it ordained by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That Section 13-4 of the Code of the City of Portsmouth, <br />Virginia, 1961, be, the same hereby is repealed. <br /> <br />2. That the Code of the City of Portsmouth, Virginia, 1961, <br />be amended by amending Sections 13-2, 13-5, 13-14.1, and <br />13-24 thereof, and by adding thereto new Sections numbered <br />13-23.1 and 13-23~2, such amended and new sections to read as <br />follows: <br /> <br />Section 13-2. Receptacle for garbage and trash, <br /> generally. <br /> <br /> It shall be unlawful for any garbage or trash to be <br />set upon the streets of the city, unless the same is placed in <br />properly sealed plastic or polyethylene refuse bags that meet <br />or surpass the minimum standards of the National Sanitation <br />Foundation, or in water tight receptacles made of substantial <br />plastic or galvalized iron or other metal of not less than 10 <br />nor more than 32 gallons capacity and such receptacle shall be <br />covered by a tight fitting cover of substantial plastic or of <br />galvalized iron or other metal. No substance other than gar- <br />bage or trash shall be placed in such bags or receptacles. <br /> <br /> It shall be unlawful for garbage to be placed, deposited <br />or allowed to remain on any premises unless the same is placed <br />or kept in a tight metal receptacle with a tight fitting cover <br />and such cover shall be kept on such receptacle at all times, <br />except when the receptacle is being filled or emptied. Plastic <br />or polyethylene bags if used for on premises storage of <br />garbabe or refuse shall be used as liners in metal receptacles <br />with tight fitting covers and such covers shall be kept on such <br />receptacles at all times, except when the receptacle is being <br />filled or emptied. <br /> <br /> <br />
