AN ORDINANCE FOR CLOSING PORTIONS OF CUTOFF AVENUE, JACKSON AVENUE AND LAtGN ROAD IN WAShINgTON HEIGHTS. WHEREAS, Washington Heights Properties, Inc. has made application to vacate, close and discontinue the hereinafter described portions of certain streets located in the subdivision of Washington Heights; and WHEREAS, by resolution of this Council, adopted January 12, 1971, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia, 1950, as amended, to view the hereinafter portions of the said streets located in Washington Heights and to report in writing whether in their opinion, any, and if any, what inconvenience would result from discontinuing the below described streets; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing said streets; NOW, THEREFORE, be it ordained by the Council of the City of Portsmouth, Virginia, that: CUTOFF AVENUE, ms is shown on the plat of Washington Heights, bounded on the North by the Northern right of way line of Jackson Avenue and on the South by the Northern right of way line of Greenwood Drive; JACKSON AVENUE, as shown on the plat of Washington Heights, bounded on the East by the Eastern right of way line of Laigh Road and on the West by the Western right of way line of Cutoff Avenue; LAIGN ROAD, as is shown on the plat of Washington Heights, bounded on the North by the Southern right of way line of Interstate Highway #264, and on the South by the Northern right of way line of Jackson Avenue; be, and the same are hereby closed and vacated as public streets; provided, however, that the City of Portsmouth reserves unto itself the perpetual easement, right and privilege to install, maintain, operate and replace water and sewer lines within, over, under and across the above described portion of Laigh Road.
