AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1961, BY AMENDING SECTION 31-35.1 THEREOF PERTAINING TO <br />PENALTIES FOR UNAUTHORIZED EXCAVATIONS IN CITY STREETS. <br /> <br /> WHEREAS, the City of Portsmouth is authorized to en- <br />act as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with the <br />state law; and <br /> <br /> WHEREAS, the General Assembly of Virginia at its 1972 <br />session amended certain of those statutes of the Code of Vir- <br />ginia, 1950; and <br /> <br /> WHEREAS, it is therefore necessary to amend a certain <br />section of the Code of the City of Portsmouth, Virginia, 1961 <br />so as to make said section conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1972 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961 be amended and reordained to read as follows: <br /> <br />Section 31-35.1. Penalty. <br /> <br /> Any person, firm or corporation violating any of the <br />provisions of this ordinance shall be fined not less than Twenty- <br />five Dollars nor more than One Hundred Dollars for the first of- <br />fense and not less than One Hundred Dollars nor more than Five <br />Hundred Dollars for the second and subsequent offenses; and a <br />separate offense shall be deemed committed on each day during <br />or on which a violation occurs or continues. <br /> <br /> 2. That this ordinance shall be effective from and <br />after July i, 1972. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia~ at a meeting held June 13, 1972. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
