AN ORDINANCE TO CLOSE A PORTION OF SUMMIT AVENUE. WHEREAS, the Trustees for Business & Professional Men's Savings Club of Portsmouth, Virginia, have made appli- cation to vacate and close that hereinafter described portion of Summit Avenue; and WHEREAS, by resolution of this Council adopted February 22t 1972, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia, 1950, as amended, to view the hereinafter described portion of the said street and to report in writing whether in their opinion any, and if any, what inconvenience would result from the discontinuing of the below described street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing said s~reet; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that that portion of Summit Avenue described as follows be and the same is hereby closed and vacated as a public street; Beginning at the North West corner of the intersection of Summit Avenue and Chestnut Street and from said point of beginning running thence in a westerly direction along the northern line of Summit Avenue 227.53 feet thence turning and running a~ right angles in a southerly direction directly across Summit Avenue 50 feet thence running in an easterly direction along southern line of Su~it Avenue 227.53 feet thence turning and running in a northerly direction 50 feet to the point of beginning; provided, however, that the City of Portsmouth reserves unto itself the perpetual easement, right and privilege ~o install, maintain, operate and replace storm drainage ditches and lines within, over, under and across that portion of Summit Avenue described as follows: Beginning at a point which is the inter- section of the south right-of-way of Summit Avenue with the westerly right-of-way of Chestnut Street; thence in a westerly
