AN ORDIi'[AN~E TO AMEND THE CODE OF TEE CITY OF PORTS~'~OUTH, VIRGINIA, 1961, BY P~EPEALI~[G SECTIONS 19-6~, 19-6~.1, 19- 68.2, 19-68.3 AND 19-69 T~YEREOF PERTAI~'TI~IG TO SU~[DAY OB- SERVANCE, ~ORKI~[G OR TP~ANSACTING DUSI.~'[ESS A~TD CERTAI~I PE~JALTIES, AND BY AMENDING SECTION 19-4 THEREOF PERTAI~[Ik'G TO ENCOURAGING PROCURING OF ABORTION BY ~DVEHTISEMENT. %~EREAS~ the City of Portsmouth is authorized to enact as ordinamces certain statutes from the Code of Virginia, provided such ordinances are substantially consis- tent with the state law~ and ~EREAS, the General Assembly of Virgznma at its 1972 session amended certain of those statutes of the Code of Virginia, 1950; and ~[[EREAS, it is therefore necessary to amend certain sections of the Code of the City of Portsmouth, Virginia, 1961 so as to make said sections conform to the changes in the Code of Virginia enacted by tke General Assembly at its 1972 session. NOW, T~IEREFORE, BE IT ORDAI~TED by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, Virginia 1~61 be amended by repealing sections 19-6~, 19- 68.1, 19-68.2, 19-68.3 and 19-69. 2. That the Code of the City of Portsmouth, Virginia, 1961 be amended and reordained to read as follows: Section 19-4. Encouraging procuring of abortion by adver- tisement, etc. If any person, by publication, lecture, adver- tisement, or by the sale or circulation of any publication, or through the use of a referral agency for profit, or zn any other manner, encourage or promote the procuring of an abortion or miscarriage to be performed in this city which ms prohibited under Article 7, Chapte~ 2, Title 1~ of the Code of Virginia, 1950, he shall be guilty of a misdemeanor. 3. That this ordinance shall be effective from and after July t, 1972. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held June 27, 1972.
