P2~ O~,Dxz~AnCE TO A~,iEIfD THE CODE OF TIlE CITY OF PORTSMOUTH, <br /> IRGL~IA, 1961, BY ADDIz~G TO CHAPTEA 27 THEREOF, A ~,1~. <br />ARTICLE COI~SISTING OF ONE SECTION, PE~TAI~I~G' TM ~'? ~ TO GOING <br />OUT OF BUSINESS SALES. <br /> <br /> ~naREAS, the City of Portsmouth is autnorlzed~ ' to <br />enact as ordinances certain statutes from the Code of Virginia, <br />~rovmaea such ordinances are substantially consistent with <br />the state law; and <br /> <br /> W!iEREAS, the General Assembly of V'mrgmnla' ' at its <br />1972 session amended certain of those statutes of the Code <br />of Virginia, 1950; and <br /> <br /> ~HEREAS, it is therefore necessary to amend a cer- <br />tain chapter of the Code of the City of Portsmouth, Virginia, <br />so as to make said chapter conform to the changes in the Code <br />of Virglnia enacted by the General Assembly at its 1972 <br />session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of P~rtsmouth, Virginia: <br /> <br /> 1. That the code of the City of Portsmouth, Virginia, <br />1961 be amended by adding to Chapter 27 thereof a new article, <br />such new article to read as follows: <br /> <br />Article III. Going out of business sales. <br /> <br />Section 27-6. Permit required for going out of business sales. <br /> <br /> (a) It shall be unlawful for any person to advertise, <br />or conduct a sale for the purpose of discontinuino a retail <br />buszness, or to modify the word "sale" in any advertzsement <br />with the words "going out of business" or any other words <br />which tend to insinuate that the retail business is to be <br />discontinued and the merchandise liquidated, unless such <br />person obtains a permit to conduct such sale from the Commiss- <br />ioner of Revenue. <br /> <br /> (b) Ail applications for such special sale permits <br />shall be accompanied by an inventory of all goods which are <br />to be offered for sale during the sale and only the goods <br />specified in the inventory list may be advertised at a <br />reduced price or sold at a reduced price during the sale <br />period. <br /> <br /> (c) Each such special sale permit shall be valid <br />for a period of no longer than thirty days, and any extension <br /> <br /> <br />
