AN ORDII~NCE TO A~ND THE CODE OF THE CITY OF PORTSHOUTt{, <br />VIRGINIA, 1961, BY ~-~NDING SECTIONS 31-51 AND 31-53 THERE- <br />OF PERTAINING TO ASSESSMENTS FOR LOCAL IMPROVEHENTS AND HOW <br />COST ASSESSED OR APPORTIONED. <br /> <br /> WHEREAS, the City of Portsmouth is authorized to <br />enact as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with <br />the state law; and <br /> <br /> ~qEREAS, the General Assembly of Virginia at its <br />1972 session amended certain of those statutes of the Code of <br />Virginia, 1950; and <br /> <br /> WHEREAS, it is therefore necessary to amend certain <br />sections of the Code of the City of Portsmouth, Virginia, <br />1961 so as to make said sections Conform to the changes in <br />the Code of Virginia enacted by the General Assembly at its <br />1972 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAI~ED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961 be amended and reordained to read as follows: <br /> <br />Section 31-51. City may impose assessments. <br /> <br /> The city may impose taxes or assessments upon the <br />abutting property owner or abutting property owners for <br />replacing or enlarging =he walkways upon then existing streets, <br />for improving and paving then existing alleys, and for e~ther <br />the construction or the use of sanitary or storm water sewers <br />including retaining walls, curbs and gutters; however, such <br />5axes or assessments shall not be in excess of the peculiar <br />benefits resulting from the improvements to such abutting <br />property owner or owners, and no assessment for retaining <br />walls shall be imposed upon any property owner who does not <br />agree to such assessment. <br /> <br /> In addition to the foregoing, the city may impose <br />naxes or assessments upon abutting property owners for the <br />construction, replacement or enlargement of sidewalks, san- <br />itary sewers or storm water sewers; for the construction or <br />installation of canopies or other weather protective devices; <br />for the installation of lighting in connection with the fore- <br />going; and for permanent amenities, including, but not limited <br />to, benches or waste receptacles, provided that such taxes or <br />assessments shall not be in excess of the peculiar benefits <br /> <br /> <br />
