~q ORDINANCE TO ~IEND THE CODE OF TtIE CITY OF PORTSMOUTH, <br />VIRGINIA, 1961, BY ADDING TO CHAPTER 18 THEREOF, A NEW <br />SECTION PERTAINING TO EMISSION CONTROL SYSTEMS ON MOTOR <br />VEHICLES. <br /> <br /> ~,~tEREAS, the City of Portsmouth is authorized to en- <br />act as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with the <br />state law; and <br /> <br /> WHEREAS, the General Assembly of Virginia at its 1972 <br />session amended certain of those statutes of the Code of Vir- <br />ginia, 1950; and <br /> <br /> WHEREAS, it is therefore necessary to amend a certain <br />chapter of the Code of the City of Portsmouth, Virginia, 1961 <br />so as to make said chapter conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1972 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the code of the City of Portsmouth, Virginia, <br />1961 be amended by adding to Chapter 18 thereof a new section <br />such new section to read as follows: <br /> <br />Section 18-248.1. Emission control systems on motor vehicles. <br /> <br /> (a) No motor vehicle registered in this State and <br />manufactured for the model year nineteen hundred seventy-three <br />or for subsequent model years shall be operated on the highways <br />of this city unless it is equipped with an air pollution control <br />system or device, or combination of such systems or devices, such <br />as a crank case emission control system or device, exhaust <br />emission control system or device, fuel evaporative emission <br />control system or device, or other air pollution control system <br />or device which has been installed in accordance with federal <br />laws and regulations. <br /> <br /> (b) It shall be unlawful for any person ~o operate <br />a ~notor vehicle as herein described, on the highways of this <br />city with the pollution control system or device removed or <br />otherwise rendered inoperable. <br /> <br /> (c) It shall be unlawful for any person to operate <br />a motor vehicle as herein defined, on the highways of this city <br />equmpped with any emission control system or device unless it <br />xs of a type installed as standard factory equipment or com- <br />parable to that designed for use upon the particular vehicle <br /> <br /> <br />
