AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1961, BY ADDING TO CHAPTER 19 THEREOF, CERTAIN NEW <br />SECTIONS PERTAINING TO POSSESSION OF CERTAIN ILLEGAL DRUGS <br />AND CONTROLLED SUBSTANCES* <br /> <br /> WHEREAS, the City of Portsmouth is authorized to en- <br />act as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with the <br />state law; and <br /> <br /> WHEREAS, the General Assembly of Virginia at its <br />1973 session amended certain of those statutes of the Code of <br />Virginia, 1950; and <br /> <br /> WHEREAS, it is therefore necessary to amend a certain <br />chapter of the Code of the City of Portsmouth, Virginia, 1961 <br />so as to make said chapter conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1973 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia: .- .~ <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by adding to Chapter 19 thereof two new sections, <br />such new sections to read as follows: <br /> <br />section 19-13.1. Possession of controlled substances unlawful. <br /> <br /> (a) It shall be unlawful for any person knowingly. <br />or intentionally to possess a Schedule III controlled substance <br />as d~fine~ or enumerated in ~ 54-524.84:7 9nd 54-524.84:8, Code <br />of Virginia (1950) or the controlled substamce marihuana unless <br />the substance was obtained directly from, or pursuant to, a <br />valid prescription or order of a practitioner while acting in <br />the course of his professional practice, or except as otherwise <br />authorized by this chapter. <br /> <br /> Upon the prosecution of a person for a violation <br />of this section, ownership or occupancy of premises or vehicle <br />upon or in which a controlled substance was found shall not create <br />a presumption that such person either knowingly or intentionally <br />possessed such controlled substance. <br /> <br /> (b) Any person who violates this section shall upon <br />conviction be confined in jail for not more than twelve months <br />and fined not more than one thousand dollars. <br /> <br /> (c) Whenever any person who has not previously been <br />convicted of any offense under this chapter or under any statute <br /> <br /> <br />
