the subject structure. In no event shall the franchisee install <br />poles in other areas of the city without prior approval of the <br />department. If the city at a future date requires additional <br />utilities to be placed underground in all or part of the city, the <br />franchisee shall conform to such ordinance at its own expense and <br />shall not seek damages from the city for such compliance nor shall <br />it assess its customers any direct charges for the costs of the re- <br />quired construction~ <br /> <br />Section 5A-26. Public property. <br /> <br /> (a) Should the grades or lines of tD~e streets which the <br />franchisee hereby authorized to use and occupy be changed at any <br />time during the term of the franchise granted, the franchisee shall, <br />if necessary, at its own cost and expense~ relocate or change its <br />system so as to conform with such new grades or lines. <br /> (b) Any alteration to the water mains, sewerage or drain- <br /> age syst~ or to any city~ state or other public structures in the <br /> streets required on account of the presence of the system in the <br /> streets shall be made at the sole cost and expense of the franchisee. <br /> During any work of constructing, operating or maintaining of the <br /> system, the franchisee shall also, at its own cost and expense, pro- <br /> tect any and all existing structures belonging to the city. All <br /> work performed kY the franchisee pursuant to this subsection shall <br /> be done in the manner prescribed by the city or other officials hav- <br /> ing jurisdiction therein. <br /> <br /> Section 5A-27. Installations at city or public buildings. <br /> <br /> The franchisee shall construct or install and maintain <br /> at its own expense such service drops, outlets, converters and other <br /> equipment or ~acilities at city or public facilities as may be speci- <br /> fied in the franchise. <br /> <br />Division 3. System Operation. <br /> <br />Section 5A-28.
