D2~ ORDINDJ~CE TO CLOSE A PORTION OF KING STREET BETWEEN POTO~J~C <br />AVENUE AI[D AIRLINE BOUL~VARD (S-73-8). <br /> <br /> ~iEREAS~ Self Service Restaurants~ inc.~ has made ap- <br />plication to vacate and close that hereinafter described portion <br />of King Street; and <br /> <br /> WHEREAS, by resolution of this Council adopted May 22, <br />1973~ viewers were appointed pursuant to Section 15.!-364 of <br />the Code of Virginia~ 1950~ as amended~ to view the hereinafter <br />described portion of the said street and to report in writing <br />whether in their opinmon any, and if any, what inconvenience <br />would result from the discontinuing o~ the below described <br />street; and <br /> <br /> ~VHEREAS, the said viewers have reported in writing <br />that in their opinion no inconvenience would resuit from closing <br />and discontinuing said street[ <br /> <br /> NOW~ T~[EF%EPORE~ BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia, uhat the following described <br />portion of King Street, be and the same is hereby closed and <br />vacated as a public street: <br /> <br /> Ail that certain piece or parcel of land <br />lying and being in the City of Portsmouth~ <br />Virginia~ and being that portion of King <br />Street lying between the east line of Poton~c <br />Avenue (formerly ~amilton Avenue~ and the <br />northwest line of Airline Boulevard. <br /> <br /> AND BE IT FURTi~R ORDAII~ED that this street closure <br />shall be made expressly subject to the following perpetual ease- <br />ments~ rights and privileges which shall be reserved unto the <br />City o~ Portsmouth, Virginia.: <br /> <br /> 1. An easement covering the northerly twelve (12) <br />feet of the area so closed and vacated to maintain, operate and <br />replace the fifteen (15) inch coDcrete storm dramn and cash iron <br />pipe drop inlet located therein~ and <br /> <br /> 2. An easement twelve (12) feet wide, the center <br />line of which is parallel nc Potomac Avenue and is located 32 <br />feet~ more or less~ east of tile eastern right of way line cf <br />Potomac Avenue, to malntain~ operate and replace the storm drain <br />pipe located therein. <br /> <br /> ~Jopted by the Council of the City of Portsmouth, Vir- <br />ginia~ at a meeting held June 26~ 1973. <br /> <br /> <br />
