effective date of the member's retirement or the date of written <br />notification to the board of retirement of the member, revoke such <br />an election by written notification to the board. <br /> <br />Section 26-42. Payment of death benefits. <br /> <br /> Ail lump sum payments failing due under this article <br />upon the death of a meraber or former member shall be paid to such <br />person or person%~ if any, as the mermber shall have designated to <br />be the beneficiary thereof, otherwise to the executors or admini- <br />strators of the member. Any such beneficiary designation shall <br />be made in writing and filed with the board in such manner as may <br />be required by the board. Any such designation may be changed <br />from time to time by the member by his filing with the board a <br />new written designation. <br /> <br />Section 26-46~ Social Security benefits. <br /> <br /> (a) If a m~mber or beneficiary does not qualify for, <br />or iosesr primary Social Security benefits to which he is entitled <br />under the Social Security Act because of his failure to make appli- <br />cation therefor, entering into covered employment or otherwise~ <br />such primary Social Sec~ity benefits shall nevertheless be con- <br />sidered as being received by such member or beneficiary for 'the <br />purpose of this article. <br /> <br /> (b) If in the determination of tine amount of any re- <br />tirement allowance payable under any of the provisions of this <br />article it ~s necessary that the amount of the actual Social Se- <br />curity benefit of a member or of the beneficiary of a member be <br />~own~ it shall be the responsibility of such m~mber or such <br />beneficiary to supply such information to the board on request~ <br />If such information is not supplied when requested, the board <br />may ~.ake such reasonable assumptions as it deems proper as to <br />the amount of such Social Security benefit° <br /> <br />1973. <br /> <br />This act shall take effect from and after July 1, <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held June 26~ 1973. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br />-15- <br /> <br /> <br />
