AN ORDINANCE TO AMEND SECTION 32-3 OF THE CODE OF T!~E CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO TP~ ISSUANCE OF PER- <br />MITS TO EXCAVATE WITHIN THE CITY'S STREETS AND RIGHT OF WAYS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br />Portsmouth~ <br />as follows: <br /> <br /> That Section 32-3 of the Code of the City of <br />Virginia, 1973, be amended and reordained to read <br /> <br />Section 32-3. Lowering curbs; laying private driveways or ramps. <br /> <br /> No person shall lower the curb on any street~ or lay <br />any private driveway or ramp crossing any sidewalk of the city <br />without first obtaining a permit therefor from the city engineer, <br />All such driveways or ramps shall be constructed and curbs <br />lowered according to plans to be furnished by the city engineer, <br />for which plans the applicant shall pay seven dollars and fifty <br />cents; and under the supervision of the city engineer, subject <br />to such conditions as he may prescribe as to materials used and <br />manner of construction. All such driveways or ramps shall be <br />fully paved over their ent±re width between the edge of the <br />pavement of the street and the property line of the property <br />to be served by such driveway or ramp. All paving and repaying, <br />where necessary~ shall be done at the expense of the person <br />receiving., such per-mit. It shall be the duty of the owner of <br />such driveway at all times to keep the side%~alk crossed by <br />such driveway or ramp in good repair at his own expense. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held May 28, 1974. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
