AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AMENDING SECTION 40-30 THEREOF PERTAINING TO THE APPLI- <br />CABILITY OF ZONING REGULATIONS. <br /> <br /> Be it ordained by the 'Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. The Code of the City of Portsmouth, Virginia, 1973, <br />be amended b~amending Section 40-30 of said Code, such amended <br />section to read as follows: <br /> <br />Section 40-30. Zoning Affects Every Building andUse. <br /> <br /> No building or land shall hereafter be used and no build- <br />ing or part thereof shall be erected, moved or altered unless in <br />conformity with the regulations herein specifiedfor the district <br /> n whach at as located, except as hereinafter provided. The provi- <br />sions of this ordinance shall not be construed to prohibit the re- <br />habilitation, repair or use of a residential structure located <br />within a residential district where the structure is to be used <br />temporarily as a bona fide project area officeby a housing authority <br />created in accordance with the provisions of Section 36-4, Code of <br />Virginia (1950). This provision shall apply only where pertinent <br />state or federal regulations require the establishment of such an <br />office in a renewal or conservation districtand where the city has <br />entered into a valid cooperation agreement approving such project. <br />All construction, rehabilitation, repairs and alterations to the <br />structure shall be consistent with the ultimate use of the structure <br />as a residence. In no case shall the use as an office be continued <br />beyond the date on which the renewal or conservation project is <br />closed out or the project no longer requires a site office under <br />state or federal regulations, whichever comes first. <br /> <br />2. This ordinance shall take effect from the date of its <br /> <br />passage. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held February 26, 1974. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
