AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973, BY AMENDING SECTIONS 3i-69 AND 3!-154 THEREOF <br />PERTAINING TO THE REFUND OF ACCUMUI~TED CONTRIBUTIONS IN THE <br />RETIREMENT SYSTEM. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virgmnla: <br /> <br /> 1. That the Code of the City of Portsmouth~ Vir- <br />ginia~ 1973, be amended by amending Sections 31-69 and 31-154 <br />thereof, such amended sections to read as follows: <br /> <br />Section 31-69. Refund of acc~mu!ated contributions. <br /> <br /> (a) Upon the retirement of a me~er or upon <br />his termination of service as an employee, other than by <br />d <br /> ea~h~ he shall be paid~ on demand, but not later than ninety <br />(90) days thereafter, the amount of his accumulated contribu- <br />tions~ i~ any, in a tu~p sum~ provided that i~ the amount of <br />such accumulated contributions is less th~n ten dollars ($i0..00)~ <br />no such p ymen~ shall be made. <br /> <br /> (b) Should a member die at any time while zn <br />servlce~ the amount of his accumulated contributions shall be <br />paid in a lump sum in aceordanqe with section 31-75~ provided <br />~na~ ~ ~he amoun~ o~ such accumulated con~r!butmons i~ ~ess <br />than ten dollars $10~00), no such payment shall be made. <br /> <br /> (c) Notwithstanding provisions of subsections <br />(a) and (b) of this section, the Retirement Board may elect to <br />refund all such accumulated contributions at any time if it <br />finds that such action is in the best interests of the retire- <br />~ent system. <br /> <br />Section 31-154. Refund ofaccumu!ated c~ntribu~ions. ~ <br /> <br /> (a) Upon the retirement of a~ ~mber or <br />termination of service as an employee, other than by death, he <br />shall be paid, on demand, but not later -than ninety (90) days <br />thereafter, the amgunt of his accumulated contributions~ if <br />any, zna lump sum; provided that if the amount of such accumu- <br />lated contributions is less than ten dollars ($10.00), no such <br />pak~ent shall be made. <br /> <br /> (b) Should a me~er die at any time while in <br />service, the amount of his accumulated contributions shall be <br />paid in a lump sum mn accordance with section 31-160; provided <br />that if the amount of such accumulated contributions is less <br />than ~en dollars ($i0.00), no such payment shall be made. <br /> <br /> <br />
