AN ORDINANCE TO AMEND THE CODE OF THE CiTY OF PORTSMOUTH~ VIR- <br />GiNIA, 1973, BY ADDING THERETO A NEW SECTION NUMBERED 35-224.1 <br />PERTAINING TO ELIGIBILITY FOR TAX RELIEF OF CERTAIN ELDERLY <br />PERSONS. <br /> <br /> Be it ordained by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, 1973, <br />be amended by adding thereto a new section n~mbered 35-224.1, <br />such new section to read as follows: <br /> <br />Section 35-224.1. Eligibility of displaced persons. <br /> <br /> (a) Notwithstanding the provisions of subsection (c) <br />of Section 35-224, a taxpayer who is otherwise eligible for <br />a tax exemption under this article shall not be deprived of <br />such exemption if compelled by eminent domain proceedings, <br />the threat of such proceedings or act of God %o abandon the <br />residence to which such tax exentption appertains. The tax <br />exemption applicable to the residence which the taxpayer is <br />forced to abandon shall be transferable to any residence pur- <br />chased by the taxpayer ~ithin twelve months after title to <br />the first residence is conveyed or condemned. <br /> <br /> (b) Any taxpayer seeking a transfer of an exemption shall <br />make application therefor on forms provided by the director. <br />Such forms shall include an affidavit reciting the facts which <br />demonstrate eligibility for such exemption. If the director <br />finds that the applicant is eligible for such exemption, he shall <br />so certify to the city treasurer. The city treasurer shall there- <br />upon deduct the exempted amount from the applicant's real estate <br />tax liability. The exemption transfer, if granted, shall take <br />effect from the date of the filing of the transfer application. <br /> <br />2.
