AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973~ BY A~NDING SECTION 33-3 OF SAID CODE PERTAINING TO PRE- PARATION AND RECORDATION OF SUBDIVISION PLATS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 33-3 of the Code of the City of Ports- mouth, Virginia, 1973, be amended and reordained to read as follows: (a) Any owner or proprietor of any trac~ of land, or any condominium which is located within the city, who subdivides such tract or condominium subsequent to approval by City Council~ or who causes any streets, alleys, or public areas to becreated, shall cause a plat to be made of such subdivision and streets, alleys and public areas, and shall also cause s~ch plat to be recorded in the office of the clerk of the Circuit Court of the city. Such plat shall be prepared in accordance with the require- merits of this chapter. (b) The clerk of the aforesaid court shall not file or record any such plat or any copy thereof required by this chapter to be recorded until such plat or copy thereof shall have been approved, and such approval evidenced thereon, in accordance with the provisions of this chapter. (c) No building permit shall be issued for the erection of any structure or building to ba located in any subdivision within the city; a plat whereof is required to be recorded pursuant to the provisions of this chapter until such plat shall have been admitted to record as herein provided. (d) Every such plat shall be prepared by a land sur- veyor, duly licensed by the Commonwealth of Virginia, who shall endorse upon each such plat a certificate signed by him setting forth the sources of the title of the owners of the land sub- divided, the place of record and deed book reference of the last instruments in the chain of title, and the outlines of the several tracts shall be indicated upon such plat. (e) Every such plat shall contain a statement to the effect that the subdivision, as it appears in the plat, is with the free consent and in accordance with the desire of the owners, proprietors, and trustees, if any. The statement shall be signed by the owners, proprietors and trustees, if any, and shall be duly acknowledged before some officer authorized to take acknowledgment of deeds. (f) No reservation of any fee in any public street or other land to be dedicated for public use shall be made by the
