A~ ORDINANCE TO ~4END THE CODE OF THE CITY OF PORTSMOUTH, VIR- GINIA, 1973, BY AMENDING SECTION 38-82 THEREOF, PERTAINING TO SEWER LINE CONNECTION FEES. BE IT ORDAINED by the Council of the City of Ports- mouth, Virginia: 1. That Section 38-82 of the Code of the City of Porusmouth, 1973t be amended and reordained to read as follows: Section 38-82. Sewer Line Connection Fees. (a) Where the City of Portsmouth installs sani- tary sewer improvements, the Director of Public Utilities shall give notice to affected homeowners of the availability of sewer line service upon completion of the lines. Homeowners shall then have thirty (30) days from the date of the giving of such notice to apply for a sewer connection and pay these sewer con- nection fees established by Section 6-8 of this Code. (b) Any homeowner that fails to apply for a sewer connection and pay the requisite fee within the time limits es- tablished by Subsection (a) shall, if he thereafter seeks to ob- tain a sewer line connection, pay a sewer line fee of Two Hundred Fifty and 00/100 ($250.00) Dollars. Such sewer line fee shall be in addition to the sewer connection fee established by Section 6-8 of this Code. (c) Where sewers have heretofore been installed 'by the City of Portsmouth, the Director of Public Utilities shall proceed to give the notice authorized by Subsection (a) to the affected homeowners. Homeowners who have access to existing lines shall then have until January 1, 1975 to apply for a sewer con- nection and pay the fees established by Section 6-8 of this Code. Homeowners having access to existing lines who do not make such application and pay such fee shall thereafter be liable for pay- ment of the sewer line fee in the manner set forth in Subsection Cb)~ (d) Notwithstanding any of the foregoing pro- visions of the sewer line fee of two hundred fifty dollars ($250.00) established by subsection (b) shall not be charged where a new home is constructed. (e) Ail notices required by this section shall be deemed sufficient if published one time in a newspaper having general circulation in the City of Portsmouth.
