AN ORDINANCE AMF~DING SECTION 33-56 OF THE CITY CODE PER- <br />TAINING TO OFF-SITE DRAINAGE IMPROVEMENTS INCLUDING ONLY <br />T~OSE IMPROVEMENTS PAID FOR BY LOCAL FUNDS. <br /> <br /> BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> That Section 33-56 of the Code of the City of <br />Portsmouth, Virginia, t973r be amended and reordained to <br />read as follows: <br /> <br />Section 33-56. Off-site Drainage Improvements. <br /> <br /> Whenever construction of a subdivision~ develop- <br />ment or improvement of land may cause, contribute or add <br />to existing or proposed off-site drainage (facilities other <br />than those required to provide internal drainage within <br />such construction) r such subdivider, developer or improver <br />shall: <br /> <br /> (a) Construct such off-site drainage facilities <br />in accordance with plans and specifications approved by the <br />City Engineer. Construction by the developer shall be under- <br />taken only if permitted by the City Engineer. The subdivider <br />shall pay the cost or so much thereof as the City Shall <br />direct; or <br /> <br /> (b) Contribute his pro rata share of local funds <br />expended for construction of existing off-site drainage or <br />contribute his pro rata share of local funds estimated to <br />pay for the construction of off-site drainage that properly <br />controls storm water flow in a designated drainage area. <br />Local funds within this section are differentiated and <br />exclude funds received by the City from federal or state <br />government grants. <br /> <br /> (c) The pro rata share to be contributed by <br />subdividers, developers and improvers shall be calculated <br />as follows: <br /> <br /> (1) Drainage areas shall be designated <br />by the City Engineer in accordance with sound engineering <br />principles. <br /> <br /> (2} Off-site drainage facilities needed to <br />properly control present and anticipated storm water flow <br />in such areas shall be designed by the department of En- <br />gineering in accordance with sound engineering principles <br />taking into consideration (among other things) the zoning <br />and zoning patterns of the subject drainage area, the <br />duration and frequency of rainfall in such area during <br />a storm return period of five (5) years using U.
