AN ORDINANCE AMENDING THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, SECTION 40-51 THEREOF, PERTAINING TO EXISTING <br />PLOTS OF INSUFFICIENT SIZE; AUTHORIZING THE BUILDING OFFICIAL <br />TO ISSUE BUILDING PERMITS ON CERTAIN CONDITIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth~ Virginiai that Section 40-51 of the Code of the <br />City of Portsmouth~ Virginia~ 1973, be amended and reordained <br />to read as follows: <br /> <br />Section 40-51o <br /> <br />Existing plots of insufficient size; <br />authorizing the Building Official and <br />Board of Zoning Appeals to issue permits <br />on certain conditions. <br /> <br /> (1) When the owner of a plot at the time of adoption <br />of this chapter or his successor in title thereto does not <br />own sufficient land to enable him to conform to the dimen- <br />sional requirements of this chapter, such plot may be used <br />as a building site only for a single-family residence, <br />provided that: <br /> <br /> (a) In those cases where the plot area, plot <br />width and/or side yards are not more than twenty (20) per- <br />cent below the minimum specified in this chapter and the <br />other dimensional requirements are otherwise complied with, <br />the building official is authorized to issue a building <br />permit for a single-family residence. <br /> <br /> (b) In those cases where the plot area, plot <br />width and/or side yards are more than twenty (20)~percent <br />below the minimum specified in this chapter or other dimen- <br />sional requirements cannot be met, the Board of Zoning <br />Appeals is authorized to approve as a variance such dimen- <br />sions as shall conform as closely as possible to the required <br />dimensions. <br /> <br /> (c) In each instance hereunder, the Building <br />Official or Board of Zoning Appeals shall investigate and <br />determine that the provisions of Sections 40-41 and 40-42 <br />have not and will not be violated by the issuing of a <br />building permit or granting of a variance. The results of <br />such investigation shall be reduced by writing and filed. <br /> <br /> (2) When the City Council has designated an area <br />to be a redevelopment area, conservation area or historic <br />district, and the Planning Commission has approved a sub- <br />division or the Planning Director a minor subdivision in <br />such designated area~ the Building Official shall issue <br /> <br /> <br />
