AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973r BY AMENDING SECTION 32-5 TBEREOP, PERTAINING TO <br />OBSTRUCTION IN STREETS AND SIDEWALKS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia, that Section 32-5 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 32-5. Obstructions and Encroachments. <br /> <br />(a) Definitions. <br /> <br /> The following words when used in this article <br />shall, for the purpose of this section, having the <br />meanings respectively ascribed to them. <br /> <br /> Owner: The person who holds legal title to a <br />building or the land upon which it is situated, <br />either or both. <br /> <br /> Street: Every public way or place of whatever <br />nature in the City including a street, alley, road <br />or highway, whether or not actually or physically <br />opened to public use and travel. <br /> <br /> Encroachment: An awning, fire escape, shutter, <br />sign, cornice, gutter, downspout, bay window or other <br />appendage to a building existing or to be constructed <br />in, upon or over the streets, sidewalks or alleys of <br />the City. <br /> <br />(b) Existing encroachments: <br /> <br /> Every encroachment existing pri~r to August 24, <br />1976 is presumed to have been constructed under au- <br />thority of a revocable permit~ch-may be revoked <br />at the pleasure of the City Council or the General <br />Assembly. <br /> <br />(c) Permit required for the construction of en- <br />croachments. <br /> <br /> The City Council or their designee may grant an <br />encroachment permit to one owner, which encroach- <br />ment permit will only be for improvements and alter- <br />ations to existing buildings which will not materially <br /> <br /> <br />
