AN ORDINANCE TO ~2~END THE CODE OF THE CITY OF PORRxJ~O~, VIRGINIA, <br />1973, BY AMEND/N~ SECTION 23-36 ~F, PERTAINING TO DtA/VERS OBEYING <br />SIGNS. <br /> <br />BE IT OREIAINED by the Council of the City of Portsmouth, Virgmnia: <br /> <br /> 1. That Section 23-36 of the Code of the City of Portsmouth, <br />Virginia, 1973, be ~mended to read as follows: <br /> <br />Section 23-36. Drivers to obey signs. <br /> <br /> (a) The driver of a motor vehicle, trailer or senti-trailer shall <br />obey and con~ty with the requirements of road signs, signals, markings <br />or lights erected or maintained upon the authority of the S~ate Highway <br />Conn~ssion or by local authority. <br /> <br /> (b) No provision of this section relating to the prohibition of <br />disobeying road signs or violating local traffic signals, markings and <br />lights shall be enforced against an alleged violator, if at the time and <br />place of the alleged violation, any such sign, signal, marking or light <br />ms not in proper position and sufficiently legible to be seen by an <br />ordinarily observant person. <br /> <br /> (c) The failure of such driver to obey such signs, signals, markings <br />or lights or to cc~ply with the provisions of this section shall constitute <br />a Class 2 misdemeanor. <br /> <br /> 2.
