AN'ORDIN~ TO J~4END Tfi~ CODE-OF THE CITY OF'PORTSMOLYI~t, VtRGINtA;- - <br />1973, BY A~iEG SECTION 33-56 THEREOF; PERTA/1FING TO OFF-SITE DRAIN- <br />AGE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />-- 1. Tb~t the_ Code of the City of Portsmouth~ Virginia, 1973, be <br />amended and reordained to read as follows: <br /> <br />Section 33-56. Off-site drainage. <br /> <br /> I. Residential Development - - A building penmit shall be issued <br />by the Buildingl Official for proposed construction of a residential <br />development, provided: <br /> <br />C~i- ' - .(a~ ~.f-site ~dra~,ag~e~ facilities exist ~n accordance with th~ <br /> ny, s Master,- ~age Plan ~off-slte drainage facilities are those <br />Iacmi~ties o~tside the property limits of proposed construction nec- <br />essary to ca~zy_, dr~-Jn~.age flow from such constrdction to a drainage <br />basin). <br /> <br /> (b) If such off-site drainage facility does not exist, a <br />bu~]din_~ per-mit will be issued only, if: <br /> <br /> [t) The City agrees to construct such off-site drainage <br />facilities or m~y part thereof using non-local funding sources. (Local <br />funds wit_ ~hin ~Bis section are differentiated and exclude funds received <br />by the City frc~h federal or state government grants); or <br /> <br /> I2) The developer eonsv/~acts such off-site drainage <br />facilities in a~c?.~rdance with the Master Drainage Plan pursuant to <br />Section 33-55 oB the City Code. <br /> <br /> ~ D? zssue~Joy the.
