Sixteen (16) but less than seventeen (17~ 80% <br />Seventeen (17) but less than eighteen [18) 85% <br />Eighteen (18) but less .than nineteen (19) - ' -90% <br />Nineteen (19) but .less than twenty (20) 95% <br /> <br /> (d) If after termination Of service and prior to .retirement 'as <br />prOvided in subsectio~ (c)_of Section 31-62,. subsections (a)-or ~b) of <br />this section are amended, the member's allowance calculation shall, be <br />based on the amended subsections in effect as of the date of retire~nt. <br /> <br /> (e) The foregozng provisien~ to the contrary notwithstanding, if a <br />member's retirement allowance is payable under one of- the options of ' <br />Section 31~-74, the amount- ~nd duration thereof shalt'~be determined in <br />accordance with- the. prOvisions of the applicable option. <br /> <br />~ (f) The foregoing prOvisiOns to the contrary notwithstanding, any <br />person whose membership began on or ~fter his sixtieth': (6Ohh) birthday <br />-shall not be eligible for or receive a re~iremen~ allowance as provided <br />for herein. ' <br /> <br /> (g) ~he foregoing provisions to the contrary notwithstanding, an!z <br />person whose membership began on or after his'fifty-fifth (55th) birthday <br />and after July' 1, 1977~ shall not be eligible for or receive a retirement <br />allowance as prOvided for herein unless the member' be in Service at his <br />nozmat retirement date. . ~' . <br /> <br />Section 31-65. Ordinar~ disabiliC~; retirement allowance. <br /> <br />' (a) Upon retirement as~provided in Section 31-64, on .or after July <br />1, 1977, a member shall receive an annual', retirement allowance! payable. <br />at least mon~hl_v to' him' during his lifetime and continued disability, <br />an amount determined as follows: - - - ~ . <br /> <br /> . (1) With respec~ to ~ny allowance' falling.due in a month <br />before the ~ember's normal.retirement date and before any social security <br />allowance payment falling due that is based on the r~Jd0er[s primary <br />social security benefit,' or before entitlement to total and ~ent <br />disability benefits under the'Social Security Act, two percent'(2%) of <br />his average final cc~pensation multiplied-by the number of years Of his <br />"disability credited, service", as he-reinafter defined not in excess of <br />forty (40) such years. <br /> <br /> (2) With respect to any allowance payment falling due after <br />the member's nominal retirement date, ~or in a month before the member's <br />nominal retirement date ~end ~fter any social security -allowance payment <br />falling due that is based on the member's primary social security <br />· benefit, or after entitlement to total and permanent disability benefits <br />unde~ the Social Security Act, the larger of: (i) one and fifteen one <br />hundredths percent (1.15%) of his average final, cc~pensation m~ltiplied <br /> <br /> <br />
