AN (~DINANCE TO ~ ~E C~OE OF THE CITY OF PORTS~//fH, V/R~/NIA, 1973, BY AMENDING S~CTI(I~S 23-493 AND 23-494: PERTAINING TO MALL AND MAT,T, TRANSIT BE IT Ot~%_INED by the Council of the City of Portsmouth, Virginia: 1. ~hat Section 23-493 of the Code of the City of Port_~mouth, Virginia, 1973, be amended to reed as follows: Section 23-493. Established. For the purpose of regulating traffic pursuant to the police power of the City and to insure the safety of pedestrian traffic, the following streets are hereby designated Mall and Mall transit streets, subject to the provisions of this ordinance. (1) Middle Street between High Street and King Street; (2) Middle Street between High Street and Queen Street. lV9%T,T, TP~NSIT STREETS None 2. That Section 23-494 of the Code of the City of Portsmouth, ginia, 1973, be amended to read as follows: Section 23-494. ~vehicles prohibited; exceptions. Co ~mml street or mall transit street no person-ab~l~ operate or parkanyvehicle, including butnot Iimited to automobiles, trucks, motorcycles, and bicycles, on suchstreet, other thanthe following: (a) ~zergeecy vehicles; ~) Public vehicle and equitm~nt and public u~cility vehicles and equitx~ent (other than for trausit or transportation purposes); (c) Vehicles and equipment engaged in the construction or ~nt~n~nce of such street; (d) Construction vehicles and equipment, between the hours of 9:00 p.m. and 9:00 a.m. only, while being used' in the con- struction, repair or d~molition of any build/rigs or structures adjacent to such street, provided that a ~_rmit has been first obtaJ/led-from the ~t of Building Inspection or the Depa~ t~t of Public Works; (e) Mass transit vehicles opera~ed under a franchise granted by the City Council, on a mall transit street c~ly; (f) Delivering vehicles being used at times designated by the City Manager to deliver or pick up goods which cannot be handled by hand trucks to stores which cannot be reached frc~ adjacent streets or alleys.
