AN ORDINANCE TO AMEN~ SECTION 23 CODE OF THE CITY OF MOUTH~ 1973, PERSD2~qLNG TO ~ O~EP~TI~ OF A MOTOR VEP~CLE WISE-~OUT A LICENSE PLATE OR A DECAL; ~ SECTION 23-482 OF SAID CODE. BE IT OPJ1AINED by the Council of the City of Portsmouth, Virginia: i. That Section 23-480~ Code of 'the City of Portsmouth, 1973, be amended and reordained to read as follows: Section 23-480. Operation of vehicle without license or decal; evidence of operation by owner; punishment. Any person who operates~ or any owner who pemmits to be operated, a motor vehicle upon thestreets of the City with- out first procuring license plates and a decal required by this Article shall be guilty of a Class 4 Misdemeanor. The finding of any vehicle on any of the streets, alleys, lanes, or public places of the City, without proper license plates and a decal attached thereto, shall be prima facie evi- dence that such vehicle w~s operated in the City by the owner thereof. It shall be the duty of police officers to attach to ve- hicles not displaying license plates and a decal, no%ice of the violation of this section. Such notice shall instruct the owmer to report to ~_he Clerk of the General District Court, Traffic Division of %he City~ in regs_rd to suc~a violation. Each such cwner may, within seventy--two (72) hours of the %3me when such notice was attached to susa ve~cle~ pay to the Clerk a penalty in the sum of Ten ($10.00) Doltsrs. The failure to pay said penalty witb/n 72 holrcs st~i1 be ca~e for a warrant · to be issued pursuant to Section 23-21 of this Article. If, ~fter the issuance of a l~cense plate or decal same has been lost or stolen, ~/ae penalty for operating a motor vehicle without a license plate or decal shall be ~nree ($3.00) Dollars if paid within seventy-two h~ars of the time a notice of violation is attached to the motor vehicle in violation. The failure to pay said p~nalty wi-thin 72 hoists shall be cause for a warrant to be issued pursuant to ~ 23-21 of this Article. .... 2.
