AN ORDINANCE AMENDING SECTION 24-85 OF ~E CODE OF THE CITY OF_ PORTS~0b'±~, <br />VIRGINIA,. 1973, AS AMS~DED, PERTAINING TO THE CLOSIL~ HOURS OF ~TAIN <br />DESIGN~ TENNIS COURTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, <br />that Section 24-85 of the Code of the City of Portsmouth, 1973, as amended, <br />be amended and reordained to read as follows: <br /> <br />Section 24-85. Closing hours, generally. <br /> <br /> (a) Except for the C~neral Washington Park and the tennis courts located <br />at City Park and Churchland Park, it shall be unlawful for any person, <br />without a permit issued by the Chief of Police as hereinafter provided, <br />to go on or enter upon any portion of eny City Park between the hours of <br />8:00 P. M. and 6:00 A. M. durJ3~g the period when standard ~i~ is in <br />effect and between the hours of 10:CO P. M. and 5:CO A. M. dliring <br />the period when advanced standard time (daylight saving time) is ~n <br />effect. Nothing contained herein shall he construed as prohibiting persons <br />from_, passing %b_~ough City_ Park along City Park Avenue fr~a ~h~ Atlantic <br />Coast Line Railroad tracks to Perk M~nor Road and along Park ~Lnnor Road <br />from City Park Avenue to Pennington Boulevard. <br /> <br /> (b) Upon the application of any person desiring to use the City Park <br />boat ra~p for purpose of launching or retrieving a boat during the hours <br />prohibited above, the Chief of Police shall issue a permit for such use <br />and such permit shall specify the date or dates of ~such intended use and <br />shall list the name of the applicant and all persons in his psrhy. ~e <br />applicant shall d/splay his copy of the permit to any police officer <br /> <br /> (c) It shall he unlawful for any person to go on or enter upon the <br />tennis courts at City Park and Churchiand Park between the hours ~f il:CO <br />P. M. and 6:00 A. M. during the period when standard time is in effect <br />and between the hours of 12:00 P. M. and 5:00 A. M. during the period when <br />advanced standard tim~ (daylight saving time) is in effect. <br /> <br /> (d) Any person who shall violate tt~ provisions of this section <br />shall be punished by a fine of not less th~ ten dollars ($tO.CO) nor <br />more than Five Hundred Do!lkrs ($500.00) or by confinement in jail not <br />exceeding thirty days, either or l~th. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a <br />meeting held March 28, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
