AN ORDINkNCE TO AMEND qlRE CODE OF THE CITY OF PORTS~OI/I!q, VIRGIkTLA~ <br />1973, BY ADDING TO CHAPTER 40 THEREOF~ SECTIONS 40-68~i PERIg~TING TO <br />RESTRIC±~3 INDUSTRIAL DEVELOPMENT ZONING DISTRICTS, TO BE KNOg~ AS <br />INDUSTRIAL M-1-R DISTRICTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, <br />that the Code of the City of portsmouth be amended by adding Section 40- <br />68.1 to Chapter 40 thereof to read as follows: <br /> 1. Section 40-68.1. Industrial M-1-R Districts. <br /> PURPOSE: It is expressly declared b~ the Council of the City of <br />Ports~Duth that t_he preservation of tt~ safety, health, peace, good <br />order, comfortr con~ence and general welfare shall be se~rved b~ the <br />establishment of a hiqhly restricted zoning district which protects <br />the i~habita~ts of th~ City ~r~ their residential neighborhoodsr while <br />a% the same ~, permitting the use of parcels of land stfoject to <br /> ~oz limited industry, manufacturing, <br /> cc~pliance with certain conditions = ~ <br />designed shopping centers and cc~nercial purposes. <br /> ENVIROkW~KNTAL RESTRAINTS: M-I-R zoning districts shall ~e characterized <br /> by an absence of noxious fu~es, noise, vibrations, odors, s~oke~ dust <br /> or any other industrial discharge nuisance. Any applicant may offer, or <br /> the Ci~f of Portsmouth may require performance standards capable of <br /> measurement by scientific insetS. In applying for and accepting <br /> the M-l-It zoping district designation, an applicant serves notice that <br /> any use permit and/or certificate of occupancy is subject to review and <br /> possible c~ncellation if i% comes to represent unacceptable levels of <br /> adverse environmental impact established at the tJ_w~ such use penmi% is <br /> granted. In any such case, a decision will take the form of a City <br /> Council resolution enacted after a public hearing advertised pursuant <br /> to the Code of Virginia. <br /> <br /> AVATTABTT,TTY OF UTILI'±'IES, ROADS kND ADEQUATE STORM DRAINAGE: M-!-R <br /> zoning districts shall be characterized by an availability of all <br /> essential streets and public utilities in form acceptable to the City of <br /> Portsmouth and shall not generate de~ands upon the municipal government <br /> for now streets or storm drainage. The City of Portsmouth at shy stage <br /> in the development of a M-l-lq zoning.~ district may require of an~applic~_nt _. <br /> development 'approval and'~recordation of& sul~livision- plat as p~escribed <br /> by the City Code. . · <br /> <br /> (a) USES PERMI'I't'ED PER SE IN A M-1-R ZONING DISTRICT: Within the <br /> M-1-R zoning district, the following uses are all~=d: <br /> <br /> Accessory uses and structures clearly incidental to a permitted use <br /> and which will not create a nuisance or hazard. <br /> <br />Automobile parking operated in conjunction with permitted uses and <br /> in accordance with the requirements of Section 40-48. <br /> <br /> <br />
