ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF <br />RAINTREE LANE BETWEEN RIVERSHORE ROAD AND SOUTF~A~-~TON ARCH. <br /> <br /> WHEREAS, N. H. and Jean Mosteller and others have made <br />application to vacate and close and discontinue the hereinafter <br />described portion of a certain street; and <br /> <br /> WHEREAS~ by a Resolution of this Council adopted May 9, 1978, <br />viewers were appointed pursuant to Section 15.1-364, Code of Vir- <br />ginia, 1950, as amended, to view the hereinafter described portion <br />of said street, and to report in writing whether in their opinion <br />any, and if any, what inconvenience would result from discontinuing <br />the below described street; and <br /> <br /> W~EREAS~ <br />their opinion, <br />discontinuing <br /> <br />the said viewers have reported <br />no inconvenience would result <br />of said street. <br /> <br />in writing that in <br />from the closing and <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia, that that portion of said street hereinafter <br />described be closed and vacated as a public street: <br /> <br />RAIN~REE LANE <br /> <br /> Beginning at the northeast corner of the intersection <br />of Raintree Lane and Southampton Arch; thence north along <br />the east right of way line of Rainhree Lane a distance of <br />330 feet to the south right of way line of Rivershore Road; <br />thence west 50 feet to the west right of way line of Rain- <br />tree Lane; thence south along said right of way a distance <br />of 330 feet to the north right of way line of Southampton <br />Arch; thence east 50 feet to the east right of way line of <br />Raintree Lane to the point of origin. <br /> <br /> AND BE IT FURTHER ORDAINED that the same is hereby closed and <br />vacated as a public street, that the City of Portsmouth, Virginia, <br />reserves unto itself a perpetual easement, right and privilege to <br />install, maintain, operate and replace sewer mains, sewer drains, <br />sanitary sewers, storm drains, drainage lines, water mains and <br />la~erats twenty (20') on each side of the center line of the here- <br />inabove named street. <br /> <br /> The City of Portsmouth, Virginia, also reserves unto itself <br />perpetual easements, rights and privileges to install, maintain, <br />operate and replace electric distribution lineg within, over, <br />under and across that portion of the hereinabove named street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held November 21, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
