AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973, BY ADDING TO ARTICLE II OF CHAPTER 38 THEREOF, <br />DIVISION 4 PERTAINING TO CROSS-CONNECTION CONTROL PROGRAM. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Vir'ginia, that the Code of the City of Portsmouth, Virginia, <br />1973, be amended by adding to Article II of Chapter 38, Divi- <br />sion 4 to read as follows: <br /> <br />Division 4. Cross-Connection <br /> ControtProgram <br /> <br />Section 38-67. Inspections generally; notification <br /> of violations. <br /> <br /> The Director of the Department of Public Utilities or his <br />designated agent, shall inspect the plumbing in every building <br />or premises in the City as frequently as may be necessary to <br />ensure that such plumbing has been installed and is maintained <br />in such a manner as to prevent the possibility of pollution or <br />contamination of the public water supplyc The Director shall <br />notify or cause to be notified in writing the ownert occupant <br />or authorized agent of the owner of any such building or pre- <br />mises to correct within a reasonable time, set by the Director, <br />any plumbing installed or existing contrary to or in violation <br />of this article and which may create the risk of pollution of <br />the city water supply or otherwise adverseley effect the public <br />health. <br /> <br />Section 38-67.1. <br /> <br />Inspections of reasonable times~ <br />~efusal to allow inspections; <br />emergency termination of water <br />ser~vice. <br /> <br /> (a) The director or his designated ~gent shall inspect all <br />premises or buildings d~ring reasonable hours and ~der such cir- <br />cumstances as tO minimize 'the inconvenience to the owner or occu- <br />pants of the premises or their agents~ Should any owner~ occu- <br />pant or agent refuse to allow the director access to the premises <br />for'the purpose o conducting an inspection; or should the director <br />not be 'able 'to contact the owner, occupant or agent for purposes ~ <br />of obtaining permission to inspect; the director Shall have the <br />right to apply immediately to a magistrate or other judicial of- <br />ficer for a proper warrant to carry out the necessary inspection. <br /> <br /> <br />
