AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- GINIA, 1973, BY ADDING TO ARTICLE II OF CHAPTER 38 THEREOF, DIVISION 4 PERTAINING TO CROSS-CONNECTION CONTROL PROGRAM. BE IT ORDAINED by the Council of the City of Portsmouth, Vir'ginia, that the Code of the City of Portsmouth, Virginia, 1973, be amended by adding to Article II of Chapter 38, Divi- sion 4 to read as follows: Division 4. Cross-Connection ControtProgram Section 38-67. Inspections generally; notification of violations. The Director of the Department of Public Utilities or his designated agent, shall inspect the plumbing in every building or premises in the City as frequently as may be necessary to ensure that such plumbing has been installed and is maintained in such a manner as to prevent the possibility of pollution or contamination of the public water supplyc The Director shall notify or cause to be notified in writing the ownert occupant or authorized agent of the owner of any such building or pre- mises to correct within a reasonable time, set by the Director, any plumbing installed or existing contrary to or in violation of this article and which may create the risk of pollution of the city water supply or otherwise adverseley effect the public health. Section 38-67.1. Inspections of reasonable times~ ~efusal to allow inspections; emergency termination of water ser~vice. (a) The director or his designated ~gent shall inspect all premises or buildings d~ring reasonable hours and ~der such cir- cumstances as tO minimize 'the inconvenience to the owner or occu- pants of the premises or their agents~ Should any owner~ occu- pant or agent refuse to allow the director access to the premises for'the purpose o conducting an inspection; or should the director not be 'able 'to contact the owner, occupant or agent for purposes ~ of obtaining permission to inspect; the director Shall have the right to apply immediately to a magistrate or other judicial of- ficer for a proper warrant to carry out the necessary inspection.
