AN ORDINANCE TO AMEND SECTION 14-5 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA~ 1973~ PERTAINING TO CHARGES FOR HANDLING REFUSE AT CITY INCINERATOR OR LANDFILL. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: (1) That Section 14-5 of the Code of the City of Ports- mouths Virginia, be amended and reordained to read as follows: Section 14-5. Charges for handling refuse at City incinerator or landfill° (a) Whenever incinerable refuse is brou~]t to the City incinerator by persons other than residents with refuse from their personal premises~ a fee of six dollars and seventy- five cents ($6°75) per ton or a minimu/~ fee of five dollars ($5.00) per load shall be charged for the service. (b) Delivery to a City landfill by persons other than residents of .the City with refuse from their personal abode shall pay a fee of three dollars ($3.00) per ton or one dollar and fifty cents ($1.50) per cubic yard or a minimum charge of one dollar and fifty cents ($1~50) per load, whichever is greater~ The fee for depositing rubber tires that have not been sliced~ chopped~ or otherwise sufficiently deformed to lose their rebounding characteristics in the opinion of the director of public works shall be triple the rates specified herein. (c) ~nenever refuse brought by any person to a City in- cinerator or landfill for disposal is of such vol%une or character as to cause undue expense to the City~ the director shall refuse to accept the same unless such person shall agree to pa~ a service charge based upon the cost of handling and dis- posing of such refuse.
