AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF <br />GIBBS ROAD. <br /> <br /> WHEREAS, the Estate of E. L. Boyce, Sr. has made appli- <br />cation to vacate, close and discontinue the hereinafter- <br />described portion of a certain street; and <br /> <br /> WHEREAS, by a Resolution of this Council adopted <br />January 9, 1979, viewers were appointed pursuant to Section <br />15.1-364, Code of Virginia, 1950, as amended, to view the <br />hereinafter-described portion of said street and to report <br />in writing whether in their opinion any, and if any, what <br />inconvenience would result from discontinuing the below- <br />described street; and ~ <br /> <br /> WHEREAS, the said viewers have reported in writing <br />that in their opinion no inconvenience would result from the <br />closing and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia, that that portion of said <br />street hereinafter-described be closed and vacated as a <br />public street. <br /> <br />GIBBS ROAD <br /> <br /> Ail that certain piece or ~rcei of <br />land situate in the City of Portsmouth, <br />Virginia, being known as Gibbs Road, a <br />paper street, being 40 feet in width, and <br />lying between Victory Boulevard and Da~lgren <br />Avenue, a distance of approximately 213 feet, <br />more or less. <br /> <br /> BE IT FURTHER ORDAINED that the same is hereby closed <br />and vacated as a public street, that the City of Portsmouth, <br />Virginia, reserves unto itself perpetual easements, rights <br />and priviliges to install, maintain, operate, and replace <br />sewer mains, sewer drains, sanitary sewers, storm drains, <br />water mains and laterals within, over, under and <br />across those portions of the hereinabove-named street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held February 13, 1979. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
