ORDINANCE A~.~]D!NG SECTION 4-23 OF ~{E CODE OF ~79~_ .C~.I%~ OF PO~?aTSMO~_FfH, <br />V!RGiI~LA, 1973~ PER~N~/NG _~D DOGS RL%,.~ING AT lARGE. <br /> <br />BE IT ORDAIA~D by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Section 4-23 of the Code of the City of Portsmouth, Virginia, <br />1973, be aDended and reordained to read as follc~s: <br /> <br />Section 4-23. Running at large. <br /> <br /> (a) It shall be unlawful for any person %Fno owns, keeps or <br />harbors a dog or has it in his care, or who acts as its custodian, or <br />who pez~its a dog to remain on or about a premises occupied by him to <br />si]ow such dog to run at large unless such dog is accompanied by an <br />attendant, and held leashed by a responsible person or securely muzzled <br />with a muzzle, the character of Which shall have been approved 12¥ the <br />game warden or animal control officer of the City of Portsmouth. <br /> <br /> (b) For the put, scs of this section, a dog shall be de~med <br />to ran at large WhJ.le ro~g, running or self-tronting off the property <br />of its owner or custodian ~-nd not under its o9~er's or custodian's im- <br />mediate control as defined above by being acccmue~ied by an a%tend~n%, <br />and held leashed by a responsible person or securely rmazzled with a <br />muzzle as defined above. ~my person who permits a dog to run a% large <br />or rennin unconfined, unrestricted or not penned up shall be dee~ed to <br />have violated the provisions of this section and guilty_ of a Class 4 <br />Misdemeanor. <br /> <br />Section 4-51. Violations, ~enalties. <br /> <br /> (a) Any _person who shall violate any provision of Section <br />4-1 or 4-5 of ~his C~,te as it pertains to animals ar~ fowl, or shall <br />fail to ~mp!y ~herewieJt~, sb~ll severally for each ~nd every such vio- <br />lation or non-con~.~...liance, respectively, be guilty_ of a Class 1 ~iis- <br />demeanor, punishable by a fine not to exceed One Thousand. ($t,O00.) <br />Dollars ~nd/or confiner~ent in jail not to exceed a term of twelve (12} <br />months. <br /> <br /> (b) ~Tn~rever in Chaoter 4 of the City Code as it pertains to <br />animals and fowl, or m~tters related thereto, there is an ordinance of <br />if any act is prob~--bited or is made or declared to be unlawful, or an <br />offense, or wherever in such Code or ordinance the doing of any act is <br />required or 'the fail'ore to do any act is declared to ~e unla%~ful, where <br />no specifmc penalty is provided therefor, any person vaho shall violate <br />same or shall fail to conp!y therewith, shall severally for each and <br />every suc~ violation or non-cxm~._liaunce~ respectively, be guilty of a <br />Class 4 ~sdewe~nor pup~ishable by a fine not to exceed One Hundred <br />($1OO.) Dollars. <br /> <br /> <br />
