AN ORDINANCE CLOSING A PORTION OF FAIRF~X AVENUE. I~HEREAS, Harry L. Clifford and Linda Clifford have made application to vacate, close and discontinue the hereinafter- described portion of Fairfax Avenue; and WHEREAS, by Resolution Of this Council adopted August 28, 1979, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter- described portion of said street and to report in writing whether in their opinion, any, and if any, what inconvenience would result from discontinuing the below-described street; an~ WHEREAS, the said viewers have~ reported in writing that in their opinion no inconvenience would result from closing or discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter-described portion of Fairfax Avenue be closed and vacated as a public street. FAIRFAX AVENUE Ail that certain part of Fairfax Avenue as shown on the plat Of Virginia Realty Investment Company lying between the south line of South Street and the north line of Bart Street, which is also part of Fairfax Avenue adjacent to Lots 1 and 2 in Block 45 on the west and ad- jacent to Lots 23 and 24 in Block 44 on the east as shown on said plat. (S-79-6) IT BEING FURTHER ORDAINED that the same are hereby closed and vacated as public streets, that the City of PortsmDuth, Vir- ginia reserves unto itself perpetual easements, rights and privileges to install, maintain, operate and replace gas mains, sewer mains, sewer drains, sanitary sewers, storm drains, water mains and laterals, electric power lines and telephone lines within, over, under and across said portion of Fairfax Avenue.
