AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA~ 1973~ BY AMENDING SECTION 20-78 ~IEREOF, PERTAIN- <br />ING TO COIN OPERATED DEVtCES~ <br /> <br /> BE IT ORDAINED by %he Council of the City of Portsmouthr <br />Virginia, that Section 20-78 of the Code of the City of Ports- <br />mouth~ Virginian 1973, be amended to read as follows: <br /> <br />Section 20-78. Coin operated devices. <br /> <br /> Every person selling, leasing, renting or otherwise <br />furnishing a coin operated machine or device operated on <br />the coin-in-the-slot principle~ or placing such a machine <br />or device with others shall be deemed to be a coin machine <br />operater~ Every such operator shall pay an annual license <br />tax of Two Hundred Dollars ($200°). The license tax imposed <br />by this section is not in lieu, but is in addition to, other <br />license taxes imposed by this section. Such license shall <br />not be proratable or transferable. Every coin machine operator <br />shall pay an annual license tax of Fifty Dollars ($50.) for the <br />first Five Thousand Dollars ($5~000.) and Thirty Cents ($0.30) <br />for each additional One Hundred Dollars ($1OO.) of receipts <br />from such sales~ leases, rentals or other receivables derived <br />from said coin machines or devices. <br /> <br /> The coin machine operator's license tax levied by= this <br />section shall not be applicable to operators of weighing <br />machines, automatic baggage or parcel checking machines or <br />recepticles, nor to vending machines which are so constructed <br />as to do nothing but vend merchandise or postage stamps~ or <br />provide service only, nor to operators o~ coin operated musical <br />machines or musical devices that operate on the coin-in-the- <br />slot principle, nor to operators of any machines or photomat <br />machines, nor to operators of devices or machines affording <br />rides to children or for the delivery of newspapers. <br /> <br /> Every operator who is required by this section to take <br />out a license as a coin machine operator shall furnish a <br />complete list of all machines on location and the name and <br />address of each location to the Commissioner of the Revenue <br />upon request. <br /> <br /> Every coin machine operater within the pervue of this <br />section shall deposit with the Commissioner of the Revenue <br />a bond in the amount of One Thousand Dollars ($I,OOO.) with <br />surety thereon approved by the Commissioner of the Revenue <br />to insure the filing of such list and the payment of the taxes <br />imposed by this section. <br /> <br /> <br />
