~%~f~7 ~1~ 1979 . 1 <br /> <br />AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION <br />15' ALLEY ON THE SOUTH SIDE OF COtV~MHRCE STREET. <br /> <br />OF A <br /> <br /> WHEREAS, Citizens Trust Bank and Florence Maupin, <br />Administrators CTA and Trustees under the Will of Florence <br />B. Maupin~ deceased, have made application to vacate, close <br />and discontinue the hereinafter-described portion of a certain <br />street; and <br /> <br /> WHEREAS, by a resolution of this Council adopted June 26, <br />1979, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter- <br />described oortion of said street and to report in %~riting <br />whether mn their opinion any, and if any, what inconvenience <br />would result from discontinuing the hereinafter-described <br />street; and <br /> <br />~EREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from the closing <br />-and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br /> of Portsmouth, Virginia, that a oortion of the said street <br /> hereinafter-described be closed ~nd vacated as a public street. <br /> <br /> Ail that portion of an alley 15' in <br />width, situate in the City of Portsmouth, <br />as shown on a block on the plat of Port <br />Norfolk Land Company, recorded in the <br />Clerk's Office of the Circuit Court of the <br />City of Chesapeake, Virginia~ in Map Book <br />4, Page 70 and 71, said alley extending in <br />a southerly direction from the southern <br />line of Commerce Street (formerly Seventh <br />Street), and being parallel to and between <br />Virginia Avenue and Chautauqua Avenue, to <br />the northern line of a parcel of land con- <br />veyed to Virginia Electric and Power Co~pany <br />by Deed of Florence B. Maupin~ dated May <br />t3~ 1966~ recorded in the Clerk's Office <br />of the Circuit Court of the City of Ports- <br />mouth, Virginma, in Deed Book 471, Page <br />255. <br /> <br />Section 1. BE IT FURTHER ORDAINED that the same is hereby closed <br />and vacated as a public street, that the City of Portsmouth, Vir- <br />ginia, reserves unto itself perpetual easements, rights a~d <br />privileges to ins%ail, maintain, operate and replace sewer <br />mamns, sewer drains, sanitary sewers, storm drains, gas mains, <br />water mains and laterals, electric power lines and telephone <br />lines and boxes within, over, under and across the portions <br />of the heremnabove-named street. <br /> <br /> <br />
