~%~f~7 ~1~ 1979 . 1 AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION 15' ALLEY ON THE SOUTH SIDE OF COtV~MHRCE STREET. OF A WHEREAS, Citizens Trust Bank and Florence Maupin, Administrators CTA and Trustees under the Will of Florence B. Maupin~ deceased, have made application to vacate, close and discontinue the hereinafter-described portion of a certain street; and WHEREAS, by a resolution of this Council adopted June 26, 1979, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter- described oortion of said street and to report in %~riting whether mn their opinion any, and if any, what inconvenience would result from discontinuing the hereinafter-described street; and ~EREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from the closing -and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that a oortion of the said street hereinafter-described be closed ~nd vacated as a public street. Ail that portion of an alley 15' in width, situate in the City of Portsmouth, as shown on a block on the plat of Port Norfolk Land Company, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia~ in Map Book 4, Page 70 and 71, said alley extending in a southerly direction from the southern line of Commerce Street (formerly Seventh Street), and being parallel to and between Virginia Avenue and Chautauqua Avenue, to the northern line of a parcel of land con- veyed to Virginia Electric and Power Co~pany by Deed of Florence B. Maupin~ dated May t3~ 1966~ recorded in the Clerk's Office of the Circuit Court of the City of Ports- mouth, Virginma, in Deed Book 471, Page 255. Section 1. BE IT FURTHER ORDAINED that the same is hereby closed and vacated as a public street, that the City of Portsmouth, Vir- ginia, reserves unto itself perpetual easements, rights a~d privileges to ins%ail, maintain, operate and replace sewer mamns, sewer drains, sanitary sewers, storm drains, gas mains, water mains and laterals, electric power lines and telephone lines and boxes within, over, under and across the portions of the heremnabove-named street.
