AN ORDINANC~ CONFIRMING THE DECLARATION OF A LOCAL EMERGENCY <br />BY THE DIRECTOR ~F EMERGENCY SERVICES (CITY ~NAGER), RATIFYING <br />ALL ACTIONS TAKEN~ PURSUANT THERETO, AND DECLARING A LOCAL <br />EMERGENCY AND THE END THEREOF. <br /> <br /> WHEREAS, because of the occurrence of a snow storm and <br />blizzard of unprecedented size and destructiveness occurring <br />on March 1, 1980, and continuing thereafter, and; <br /> <br /> W-~EREAS, because of the necessity for the preservation of <br />the p~blic peace, health and safety, and to preserve the lives <br />and property and economic well being of the people of the City <br />of Portsmouth, a state of emergency has been declared by the <br />Governor of the Commonwealth and a local emergency declared <br />by the Director of Emergency Services (City Manager) of the <br />City of Portsmouth, and; <br /> <br /> WHEREAS, the action of the local Director of Emergency <br />Services (City Manager) of the Cit~ of Portsmouth being deemed <br />by the Council to have been prudently undertaken must be <br />confirmed by the Council and actions taken pursuant thereto <br />ratified, now, therefore; <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> Section 1: That the local emergency heretofore declared <br />by the City Manager at 6:00 p.m., on Sunday, March 2, 1980, <br />acting as the local Director of Emergency Services in accordance <br />with authority granted in Chapter 3.2 of Title 44 of the Code <br />of Virginia, 1950, as amended, is hereby confirmed. <br /> <br /> Section 2: That the local Director of Emergency Services <br />(City Manager) is hereby authorized to exercise in the name <br />of the City all authority granted thereto by Chapter 3.2 of <br />Title 44 of the Code of Virginia, 1950, as amended, and in <br />furtherance thereof to undertake such actions as in his judgment <br />are proper including, but not limited to, 'action authorized <br />by Section 44-].46.21 of the Code of Virginia, 1950, as <br />amended, and hereby ratifies any such actions heretofore taken <br />by him. <br /> <br /> Section 3: That the local emergency declared hereby <br />expired at 5:00 p.m., on Wednesday, March 5, 1980, as declared <br />by the Director of Emergency Services. <br /> <br /> Section 4: That pursuant to the declaration of a state <br />of emergency made by the Governor of this Commonwealth on <br />March 2, 1980, and the provisions of this ordinance a local <br />emergency,e~isted in the City of Portsmouth. <br /> <br /> <br />
