AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS kMENDED, BY ~4END!NG SECTIONS 23-234, <br />23-235, AND 23-239 OF THE CODE AS IT ?ERTAINS TO THE SALE <br />OF ~AZARDOUS OR ILLEGALLY PARKED VEHICLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> i. That the Code of the City of Portsmouth, Virginia, <br />1973, be amended, by amending Sections 23-234, 23-235, and <br />23-239 to read as follows: <br /> <br />Section 23-234. 0ffice~'s report of ~emoval; notice to <br /> owner of impounding. <br /> <br /> The officer removing~ or causing the removal of any <br />motor vehicle, trailer or semi-trailer under the preceding <br />section shall i~mediately make a written report thereof to <br />the Chief of Police setting forth the date, time and place <br />of, and the reason for such removal, and the license number <br />of the motor veh±cles removed. <br /> <br /> As promptly as possible after the removal of any such <br />motor vehicle, trailer or semi~trailer, unless the same has <br />been sooner released, the Chief of Police shall notify in <br />writing the owner of record of such motor vehicle, trailer <br />or semi-trailer, if known, that such motor vehicle, trailer <br />or semi-trailer has been impounded. <br /> <br />Section 23-235. Release from impoundment upon payment of <br /> charges and costs. <br /> <br /> No motor vehicle, trailer, or semi~trailer impounded <br />under the provisions 'of this Division shall be released or <br />removed from the 'City pound, except upon payment by the owner <br />thereof, or his duly authorized representative, to the Chief <br />of Police, who shall issue a receipt therefor, of a towing <br />charge of Forty ($40.00) Dollars (in instances where add- <br />itional equipment such as dollies is required to execute <br />the tow, an additional charge of P±fteen ~$15.O0) Dollars <br />shall be added to the 'towing ckarge), plus a storage cha~ge, <br />if the motor vehicle, trailer or Semi-trailer has been <br />impounded for a period of more than twenty-four (24~ hours, <br />of Three ($3.00) Dollars per day or fraction thereof, plus <br />cost of publication of any notice required by any of the pro- <br />visions of this Code, plus cost of investigation as to owner- <br />ship and liens required by any of the provisions of this <br />Division; provided, that the ~ity Manager ~ay release any <br />such 'impounded motor ve~icle, trailer or senni-trailer from <br />the City pound witho'ut the payment of such charges and costs, <br /> <br /> <br />
