AN ORDINANCE CLOSING A PORTION OF CHARLESTON AVENUE. <br /> <br /> WHEREAS, Walter J. Carter, Sr. and Thelma J. Carter <br />have made application to vacate, close and discontinue the <br />hereinafter-described portion of Charleston Avenue; and <br /> <br /> WHEREAS, by Resolution of this Council adopted May <br />26, 1981, viewers were appointed pursuant to Section 15.1-364, <br />Code o~ Virginia, 1950, as amended, to view the hereinafter- <br />described portion of Charleston Avenue and to report in <br />writing whether in their opinion snyt and if any, what in- <br />convenience would result from discontinuing said street; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from the closing <br />and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia~ that the hereinafter-described <br />portion of Charleston Avenue be closed and vacated as a public <br />street. <br /> <br />CHARLESTON AVENUE <br /> <br /> A iO~ portioh of Charleston Avenue which is <br />the .eastern most 10' of the right-of-way of Charles- <br />ton ~venue beginning on the south side of Watts <br />Avenue (formerly Maupin Avenue) and running back <br />between parallel lines the width of 10' in a southerly <br />direction to the terminus of Charleston Avenue, said <br />iO' str~.p being contiguous to the property of <br />Walter J. Carter, Sr. and Thelma J. Carter, husband <br />and wife. <br /> <br /> BE iT FURTHER ORDAINED that the City of Portsmouth, Virginma, <br />reserves unto itself perpetual easements, rights and privileges <br />to install, maintain, operate and replace sewer mains, sewer <br />drains, sanitary sewers, electric power lines over, under and <br />across that portion of the hereinabove-named-street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held July 28, 1981. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
