AN ORDINANCE CLOSING A PORTION OF CHARLESTON AVENUE. WHEREAS, Walter J. Carter, Sr. and Thelma J. Carter have made application to vacate, close and discontinue the hereinafter-described portion of Charleston Avenue; and WHEREAS, by Resolution of this Council adopted May 26, 1981, viewers were appointed pursuant to Section 15.1-364, Code o~ Virginia, 1950, as amended, to view the hereinafter- described portion of Charleston Avenue and to report in writing whether in their opinion snyt and if any, what in- convenience would result from discontinuing said street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from the closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia~ that the hereinafter-described portion of Charleston Avenue be closed and vacated as a public street. CHARLESTON AVENUE A iO~ portioh of Charleston Avenue which is the .eastern most 10' of the right-of-way of Charles- ton ~venue beginning on the south side of Watts Avenue (formerly Maupin Avenue) and running back between parallel lines the width of 10' in a southerly direction to the terminus of Charleston Avenue, said iO' str~.p being contiguous to the property of Walter J. Carter, Sr. and Thelma J. Carter, husband and wife. BE iT FURTHER ORDAINED that the City of Portsmouth, Virginma, reserves unto itself perpetual easements, rights and privileges to install, maintain, operate and replace sewer mains, sewer drains, sanitary sewers, electric power lines over, under and across that portion of the hereinabove-named-street.
