AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-31 THEREOF, PERTAIN- ING TO THE DEFINITION OF CHILD DAY CARE CENTER AND ADULT DAY CARE CENTER; BY AMENDING SECTIONS 40-73 (b); 40-74 (b); 40- 75(b); 40-77(b); 40-78(b); 40-79 lb); 40-120(b); 40-70[a); 40-76(a); 40-79(a); 40-70(b); 40-76(b); AND 40-70(b) PER- TAINING TO CHILD DAY CARE CENTERS AND ADULT DAY CARE CENTERS AS PE~IITTED USES. BE IT ORDAINED by %he Council of the City of Portsmouth, Virginia: 1. That Section 40-31 of the Code of the City of Portsmouth, Virginia, 1973, be amended by adding thereto, the definition of ~'child day care center" and "adult day care center" Go read as follows: Section 40-31. Definitions. CHILD DAY CARE CENTER: Any facility, except a public or private school, providing care to a group of slx (6) or more children senara~ed from their parents or guardians during a part of the day on a regular basis. ADULT DAY CARE CENTER: Any facility providing care a group of four (4) or more adults separated from their families during a part of the day on a regular basis. 2. That Sections 40-73[b), 40-74(b), 40-75(b), 40- 77(b), 40~78(b), 40-79(b), and 40-120(b) of the Code of the City of Por-tsmouth, Virginia, 1973, be amended by substituting the term "C]~ild Day Care Center, Nurseries and K±ndergartens" for "Day ~series and Kindergartens", and by adding the term "Adult Day Care Centers" as a permitted use. 3. That Sections 40-70[a}~ 40-76(a), and 40-79(a) the Code of the City of Portsmouth, Virginia, 1973, be amended by deleting the term "Day Nurseries and Kinder- gartens". ~f 4. That Sections 40-70(b) and 40-76(b) of the Code of the City of Portsmouth, Virginia, 1973, be amended by adding as a permitted use "Child Day Ca~e Centers, Nurseries and Kinder- gartens" and "Adult Day Care Centers" 5. That this ordinance shall take effect from the date of its adoption. Adopted_ by the Council of the City of Portsmouth, Virginza, at a meeting held ~uly 28, 1981. Testa: City Clerk
