AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ADDING THERETO, SECTION 33-58 PERTAINING TO THE RESUBDIVISION OF PROPERTY. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, 1973, be amended by adding to Chapter 33 thereof, 33-58, such new section to read as follows: Virginia, Section Section 33-58. Resubdivision of property; certain plats. (a) The Council of the City of Portsmouth, Virginia, has determined that certain areas intended for residential develop- ment were subdivided prior to the enactment of land subdivision ordinances by Norfolk County and/or the City of Portsmouth. The Council of the City of Portsmouth further finds that there are such areas zoned for residential purposes, but due to the con- figuration of non-conforming lots and structures and to the existance of substandard City streets, a situation has been created whereby the property owners are unable to develop such areas thereby causing a hinderance to overall redevelopment in the City of Portsmouth. Therefore, the Planning Commission of the City of Portsmouth is hereby authorized to approve resubdivision plats which shall be exempt from the requirements of Sections 33-55 and 33-56 per- taining to installation of curbs and gutters, street and pave- ment widening and off-site drainage requirements upon the follow- ing conditions: (1) The current plat of the subject property predates the adoption of the Subdivision Ordinances of the City of Portsmouth and Norfolk County in 1945; and (2) The proposed resubdivision of the subject property will facilitate property improvements at a greater degree of conformity with subdivision zoning ordinances in effect at the time of the resubdivision application. (b) Each subdivision plat approved under the terms of this section shall bear the following notation: "This resubdivision approved subject to the terms and conditions of Section 33-58 of the Code of the City of Portsmouth and is sub- ject to the restrictions and requirements con- tained therein."
