AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, BY ADDING THERETO, SECTION 33-58 <br />PERTAINING TO THE RESUBDIVISION OF PROPERTY. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, <br />1973, be amended by adding to Chapter 33 thereof, <br />33-58, such new section to read as follows: <br /> <br />Virginia, <br />Section <br /> <br />Section 33-58. Resubdivision of property; certain plats. <br /> <br /> (a) The Council of the City of Portsmouth, Virginia, has <br />determined that certain areas intended for residential develop- <br />ment were subdivided prior to the enactment of land subdivision <br />ordinances by Norfolk County and/or the City of Portsmouth. The <br />Council of the City of Portsmouth further finds that there are <br />such areas zoned for residential purposes, but due to the con- <br />figuration of non-conforming lots and structures and to the <br />existance of substandard City streets, a situation has been <br />created whereby the property owners are unable to develop such <br />areas thereby causing a hinderance to overall redevelopment in <br />the City of Portsmouth. <br /> <br /> Therefore, the Planning Commission of the City of Portsmouth <br />is hereby authorized to approve resubdivision plats which shall <br />be exempt from the requirements of Sections 33-55 and 33-56 per- <br />taining to installation of curbs and gutters, street and pave- <br />ment widening and off-site drainage requirements upon the follow- <br />ing conditions: <br /> <br /> (1) The current plat of the subject property <br />predates the adoption of the Subdivision Ordinances of the <br />City of Portsmouth and Norfolk County in 1945; and <br /> <br /> (2) The proposed resubdivision of the subject <br />property will facilitate property improvements at a greater <br />degree of conformity with subdivision zoning ordinances in <br />effect at the time of the resubdivision application. <br /> <br /> (b) Each subdivision plat approved under the <br />terms of this section shall bear the following notation: <br /> <br />"This resubdivision approved subject to the <br />terms and conditions of Section 33-58 of the <br />Code of the City of Portsmouth and is sub- <br />ject to the restrictions and requirements con- <br />tained therein." <br /> <br /> <br />
