AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING ARTICLE I OF CHAPTER 23 THEREOF <br />BY ADDING SECTION 23-228 PERTAINING TO TOWING VEHICLES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Article I of Chapter 23 of the Code of the City <br />of Portsmouth, Virginia, ~973, be amended and reordained by <br />adding. Section 23-228 to read as follows: <br /> <br />Section 23-228. <br /> <br />Towing vehicles with three outstanding parking <br />violation notices. <br /> <br /> Whenever there is found any motor vehicle parked upon the <br />public streets or highways or public grounds against which there <br />are three or more outstanding unpaid or otherwise unsettled <br />parkinq violation notices or tickets, such a vehicle may, by <br />towing-or otherwise, be removed or conveyed to the City Pound <br />to be designated by the City Manager for the temporary storage <br />of such vehicle. Said removal or conveyance shall be under <br />the direction of a member of the Portsmouth Police Department. <br />It shall be the duty of the Portsmouth ~olice Department to <br />inform, as soon as practicable, in writing, the owner of the <br />removed vehicle of the natur~ and circumstances of the prior <br />unsettled parking violation notices or tickets, for which or <br />on account of which, such a vehicle was removed. The owner <br />of such removed vehicle, or other duly authorized person, <br />shall be permitted to repossess or to secure the release of <br />the vehicle by payment of outstanding parking violation notices <br />or tickets for which the vehicle was removed and by payment of <br />all towing costs and storage fees as prescribed in Section <br />23-235 of this Code and for the reasonable costs incidental <br />or incurred in the efforts to locate the owner of the vehicle. <br />Should such owner fail or refuse to pay such fines and costs <br />or should the identity or whereabouts of such owner be unkno~n <br />and unascertainable, the vehicle that was so removed may be <br />sold at public auction in accordance with the procedures set <br />forth in Section 23-239 of this Code. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held January 26, 1982. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
