_ 82-23. <br /> <br />AN ORDINANCE CLOSING A 20 FOOT ALLEY ON THE EASTERN SIDE OF <br />MARINER AVENUE. <br /> <br /> WHEREAS, John A. Bender, by his attorney George Talbot, <br />has made application to vacate and close the hereinafter- <br />described portion of a certain alley; and <br /> <br /> WHEREAS, by Resolution. adopted by. this Council on January <br />26, 1982, viewers were appointed pursuant to Section 58.1-364, <br />Code'of Virginia, 1950, as amended, to view the hereinafter- <br />described portion of said alley, and to report in wirting whether <br />in their opinion any, and if any, what inconvenience would <br />result from discontinuing the said alley; and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in %heir opinion no inconvenience would result from the closing <br />and discontinuing of. said alley. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter-described portion <br />of a certain alley located on the eastern side of Mariner <br />Avenue be closed and vacated as a public street. <br /> <br />S-82-1 <br /> <br /> A twenty (20') foot portion or strip of <br />an alley which is located on the Eastern slde <br />of Mariner Avenue, "formerly Fourth Avenue; <br />and running back between parallel lines, said <br />lines being the boundaries of Lot 309 and Lot <br />311 Mariner Avenue, one hundred feet (100') <br />a northeasterly direction to a point, said <br />t~enty (20') foot strip being contiguous to <br />the property of John A. Bender, I~c.; a Virg!nia <br />Corporation.
