Section 11-114. Rejection Of Bids. <br /> <br /> An invitaticn for bids, a request for proposals, or other <br />solicitation shall be cancelled, or any or all bids or proposals <br />may be rejected in ~ho!e or in part when the Purchasing Agent <br />with the approval of the Director of Finance determines <br />that it is in the best interest of the Cit~~ to do so. The <br />reasons therefor shall be made a part of the record in the <br /> <br />Section !1-1i5. Bid 0pening~ <br /> <br /> All bids or proposals shall be submitted in sealed envelopes <br />to the purchasing agent and shall be identified as bids on the <br />envelope. <br /> <br /> Bids shall be opened publicly at %he time and place designated <br />in the Invlmacm~n ~Qr ~ma or request for proposal. The amount <br /> "~ ' remevanu lnzommahlOn as the'purchasing <br />of each bma; and s~ch other~ <br />agent deems appropriate, together with~the name of each bidder <br />shall be recorded~ %he record and each bid shall be opened to <br />public inspection afker the bid opening. <br /> <br />Sec~:ion ti-116, withdrawal: of Bid due t~ Error. <br /> <br /> A bidder for a public construction contract, other than a <br />contrac~ for ~-~' <br /> co~.=~ ..... men or maintenance of public highways, <br />may '~-~ w bid from consideration if %he price bid was <br />substantial~!v .lower than the other bids due solely to a mistake <br />therein, provided the bid was submitted in good faith, and the <br />mistake was a clerical mistake as opposed to a judgment mistake, <br />and was actually due to an unintentional aritb_metic error or <br />an unintentional omission of a quantity of %.7ork, labor or material <br />made directly in the compilation of a bid, which unintentional <br />arithmetic error or unintentional omission can be clearly .shown <br />by objective evidence drawn from inspection of original work <br />papers, documents and_ materials used in the preparation of the' <br />bid sought to be withdrawn. <br /> <br /> The procedure for bid~withdrawal shall be stated as follows <br />ir. the advertisement for bids: . - <br /> <br /> '~The bidder~ shall submit to the purchasing <br />agent his original work papers, documents, and <br />maherials used in the preparation of the bid with- <br />mn two [2) days after ~he date fixed for opening <br />of bids. The work papers shall be delivered by <br />the bidder in person or by registered mail. Such <br />mistake shall be proved only from the original <br />work papers, documents, and materials delivered <br />as required herein." <br /> <br /> <br />
